Need some advice on Hardship with First Direct

Hi All,

I sometime ago made a claim under the "hardship" criteria and it was agreed this did apply to me.

However, the "offer" made was terrible, and I refused it. (old post showing offer was really poor)
I submitted a IvE expsense claim form - and was told I fitted the criteria - living on cards, overdrawn etc. My claim was £1400+

They have offered £150 and a reduced interest rate on my credit card and loan 1% above base rate - compared 4%. This is for 1 year -then they would review.

My card is around £3900 and a loan for £5000+

Bad offer???

I assumed this meant I would have to wait until the court case had been resolved - but I am struggling more and more and feel that a poor offer should not mean I have to wait. I have since incurred more and more fees.

What is the standing on this - do I appeal to FSA or what?

  • Do they actually consider you are in hardship?Have a look under my user name at other posts I've made comments on. FD recongised me (and others) as being in financial difficulty, but not hardship. I think the difference between the two is where priority debts (mortgage, council tax etc) are or aren't being met. As I'm on a DMP with CCCS (and therefore my priorty debts are being covered), they acknowledge that I am in difficulty, but not in hardship. I fear the FSA waiver may not apply to you therefore.
Interesting that you had an offer though - I don't know of anyone claiming against FD that have had an offer'
  • Hardship not diffculty for sure - missed rent payments etc, and as they offered (albeit terrible) they must have agreed.

    So where next?

Approach FD again and ask them to consider you in hardship with an updated list of charges and notices of arrears and what has caused the further hardship.
