Candy Oven - help please

Hi i bought a Candy oven & hob in june 2008. Didn't have them installed until September - but Candy have told me that this doesn't matter. ALready had 2 engineers out about the hob - this is okay now for the meantime. The oven - the whole front fell off 1 week after the warranty ended - it just came off in hand!! After long, long phonecall, i managed to get an engineer out for free to fix it - several screws were "missing". Then yesterday the oven tripped, and the bottom element has gone! :mad: Even though the 1 year warranty expired in june - do i have any rights? (i can't afford to replace it). I can't believe that this oven has lasted not even a year!!!

    if it's a manufacturing fault (rather than due to your electric surging) you might have a chance with sale of goods act as it's reasonable to expect an oven to last longer than a year.

    Please consider buying some pet food and giving it to your local food bank collection or animal charity. Animals aren't to blame for the cost of living crisis.

    Your first port of call is the retailer you bought it off - write to them reminding them of your statutory rights according to SOGA.

    Ignore any flannel about "out of guarantee", "you didn't purchase extra warranty".

    SOGA - in a nutshell, the goods sold must be fit for the their intended purpose for a reasonable period of time. No one will dispute your timeframe as being unreasonable.

    As its more than 6 mths old, it is up to you do demonstrate it was an inherent fault and not due to wear / tear. Retailer may cave in without given it is just out of warranty.

    If they don't, write again telling them that you'll seek an independent engineer's view and you'll pursue them for the costs. If they still don't respond favourably, enter the battle arena: You'll need to seek an reputable independent engineer to assess the problem, provide an estimate to repair and express his / her opinion as to how long the item should last. This will cost you but you'll be able to claim it back from the retailer.

    If you bought the goods on a credit card, you've got come back there too if the retailer doesn't play ball (look up Section 75 on this website).

    update - spoke to applicancesuwant - the website i purchased the oven from - says won't do anything. They say i have to go through Candy - i did say about the SOGA, but they said i still have to contact Candy.
    Phoned Candy - they wont do anything unless i pay £109 for an engineer to call out or £15.90 a month for the next year for an "extra year warranty!":mad::mad:
    I told them i was not going to do this - again stated SOGA, was basically told that i am NOT going to get it repaired for free.
    Absolutely fuming - i have 2 young children, and really cannot be without an oven.
    What should i do next?:confused:

    Quoting the SOGA to Candy is a complete waste of time. You have no contract with them at all, they didn't take your money and din't supply you with goods.

    You need to get back onto the people you bought it from and get them to resolve it under SOGA. Don't take no for an answer, make sure you write to them by recorded delivery, keep a copy of the letter for yourself and be prepared to go to TS if needs be...

  • Thanks for this. Where did you get the address from, i spoke to them today abd they gave me an address in London????? I have also been in tocuh with TS today. Am sending letter recorded delivery tomorrow.

    As people have said, your contract is with appliancesuwant, NOT Candy. Candy might be their repairer, but they have to arrange it if you want them to. Misleading people about their rights under the SOGA is an offence.
