Hi guys quick question our car failed mot needs about £500 spent on it
wifes dad said he would lend her money for another about £1 200 would ip then take this car
any ideas oh nd we havent told inlaws about bankruptcy kinda keeping it to our selfs lol

Was the car exempted in your BR? If so, the OR cannot take any replacement, it would still be exempt.

Also, if the car was exempted, the BR is required to keep it in good condition, taxed, insured AND mot'd!
I suggest informing OR of your desire to replace, rather than repair...No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -

Scottish, you don't need to inform your OR of anything as long as the first car was exempt,
There is no obligation to keep your current car repaired, taxed mot'd etc., not quite sure where Alastair got that impression from. Once a car is exempt it is your to do with as you wish and is no longer any concern of the OR.

ermm....sorry...not too good at speed reading, obviously....
I was referring to my letter from my OR regardingmy car's exemption......
The misunderstanding came from the last paragraph of my letter, where the OR feeels obliged to impress upon me that it is MY responsibility to ensure the car is correctly licenced, fit and mot's...[not the OR's......dunno where he got the impression I might send me car's MoT bill to the OR's office....still, maybe it was worth a try?}No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
I see where the confusion arose, Alastair. That paragraph is there because until the car is made exempt the OR is responsible for the upkeep etc., and as soon as the car is signed back to you it becomes your responsibility, but not obligation.

in law, it's all the driver's responsibility...to ensure VED, insurance and Mot are present......effectively the OR only temporarily becomes teh owner...not even the registered keeper...[because we don't even forward the V5c]
However, I think the question should really be....if, in between the OR's interview, and the letter from the OR agreeing to the car's exemption, one had the car repaired/serviced, would the OR be happy to pay the bill....seeing as technically, the OR owns it?

Update spoke to ip today says car exempt BUT wont put it in writing BUT does want v5 which will be returned at end of sequestration does this sound right

Hmm, he probably wants the V5 because he doesn't want your FIL buying you a £1200 car and you selling it on and buying a £500 banger
