xtraroom deposit back??

Moderator. Please move this post if it's in the wrong place
We recently commissioned a company to convert our loft...unfortunately they've let us down badly and 2wks after allegedly starting and loads of excuses we only have one hole in the party wall and a couple of bits of wood with the ends cut off. :mad:
After a firm promise that they would definitely start Monday they have let us down yet again by calling to say we will only have the men until 2pm.:eek:
I told them to take the materials off site and refund our deposit.
When they said that the deposit had been spent--£2656 -on building regs and plans etc. I said cobblers;) you're having a laugh.
The question is---can I hold on to the materials etc until we resolve the deposit issue or am I stuffed :mad:
I will take them to the small claims court for taking money for a service they didn't supply but how do I stand legally with regard to the materials?
Any advice please
Having thought about it we have decided that we can't afford to lose the deposit and my health can do without the stress of legal hassle, so we are going to have to let them do the job??.....at least I have seen the work they have done and previous customers were pleased with the quality.
