Can we claim Housing benefit if brother is the landlord?

There's no reason why you shouldn't claim LHA as long as you realise that you'll have to pay the difference in the rental price between 2 and 3 bedrooms.

Yeah I know that I will have to pay the difference. I just wanted to make sure that the part of the rent that I am claiming HB for, isn't seen as contrived.
