Hi I'm Dave and I come from Sheffield. I recently had a problem with a seller on ebay. I bought a phone from them for £60.00 and paid through paypal. after over 2 weeks the phone still hadn't arrived despite the seller saying he had posted it. he claimed that it was due to a postal strike in his area but went silent when I asked for proof of delivery so that I could see for myself if he had actually posted it. I left it a while longer then opened a dispute on ebay who directed me to paypal with the payment going through them. again the seller claimed it was due to a postal strike but went silent again when I demanded proof that he had actually posted the phone. After a few more days of not getting any contact I escallated the dispute to a claim so I could get my money back as it was clear that the phone hadn't been sent. Paypal gave the seller 10 days in which to reply but still nothing was heard. after the deadline paypal ruled the claim in my favour but only refunded me the insulting ammount of 7 pence leaving me £59.93 out of pocket.
What I'm wanting to know is there any way that I can get this money back either through paypal or from the seller as I feel as though I have been robbed and that the so called buyer protection claims that ebay and paypal make are false in that they promise they will get the full ammount of whatever you have paid for an item and postage if it turns out to be other than advertised or in my case does not turn up at all. I've currently sent an email complaining to ebay about this but so far have not received a response.

Id ring paypal and speak to someone about it, there is a contact us somewhere on paypal.com you should get the money back if the seller cant provide a tracking number showing it has been sentLaugh Often, Love Much, Live Well.0

Are you sure paypal have refunded 7p and not the seller? They might be trying to be clever.0

Phone paypal up and speak to them, as they're usually much more helpful than emails. Be polite, and they'll help you.Should've = Should HAVE (not 'of')

Check that they have processed the claim under buyer PROTECTION and not buyer complaints. If they have got it wrong, get on to them and tell them.My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Thanks for the help. it's deffinitely paypal that refunded the 7p as I got a mail from them saying they had ruled the case in my favour as the seller never contacted them within the 10 day period they gave them to reply.
If I don't get a mail back I shall give them a ring and see.

When I first paid for the item the paypal address provided by the seller was incorrect so the payment had to be canceled and resent to the correct address which the seller provided. Paypal have decided to use this as an excuse to say that I'm not covered by the buyer protection despite me providing transaction ids and item numbers and so on.
I've since emailed both paypal and ebay to try and get the matter sorted and if it's not sorted I'll have to take the matter further
