Can I claim if im in an iva?

Im in IVA which the company I want to claim against is part of. Can I still claim my ppi back even if the company is in the IVA or will they get funny and start requesting to finish the iva early etc? I dont want to send a letter off until I know what the consequences are. Can anyone help?

Yes you can reclaim but you may not get any money back in your hand. If you are successful it will probably go towards the outstanding balance of the account.

    Hi Lou

As far as I am aware you can still reclaim, if you were mis sold for any reason then go for it.
You can wait for other opinions on this as well if you want to be sure first, good luck.
Below is the link to guidelines of reclaiming, with useful info, templates and a mis selling checklist, if you require any help, post up where someone will come along to help.;)

Check the Ts & Cs of your IVA proposal. Any (successful) claim would come to you (not paid off what you owe the creditor) but would be recognised as a "windfall" and you'd have to declare it to your supervisor. The creditor couldn't get your IVA terminated as they'd have to get all creditors to agree. Just let your IP know what you're doing.
