Sleep to Live Mattress

Hi everyone
I really hope somebody can help me, we have ordered a 300 series king size mattress by Sleep to Live from Bensons for Beds.
It arrived today and I am not a happy customer and here is why;
My previous king size mattress (from Bensons) was a Silentnight king size measuring 5ft in width, I have placed the Sleep to Live mattress on my current bed frame and there is a very noticable gap around the sides in fact it looks like a double.
So I measured it and it comes to 144cm, I phoned Bensons who said king size is 150cm but that they do have a 3cm allowance. Firstly 150cm is not 5ft (152cm is) and secondly when I told her it doesn't measure even 147cm her response was that is impossible. So out came the camera I took pictures and emailed them to her to pass to the manufacturer.
I have just had a response which says that we have to sleep on it and it will spread out we do have a 40 day comfort guarantee but that basically means if the firmness rating is not what we like we can hae it replaced and they have said they will not replace it because of its size.
I have said that we will try it for the 40 days and have asked for a guarantee that if it does not spread out to 150cm that it will be replaced, so far I have been told it has to be referred to the manufacturer.
Please help, what are my rights? I have entered into a contract with Bensons not the manufacturer so shouldn't Bensons be responsible?
I also have not received any care instructions or information relating to the 10 year guarantee ir the 40 day comfort guarantee should I have had these already?

Kingsize is 150cm, at least that's what John Lewis says.
143cm is wrong, don't sleep on it. Make double plus sure of the measurements and if it's 143cm, return it.0 -

Read the section on "Claiming a refund". Then ring the Consumer Direct number and ask them to tell you exactly how to claim a refund in line with what it says on the webpage.
Act quickly, you don't get much time to claim a refund. If you prefer to have it replaced, ask Consumer Direct for advice.0 -

I have claimed a replacement and have emails between myself and Bensons in which they state that we have to sleep on it before they will proceed with any complaint.
We have slept on it and it feels a hell of a lot smaller than we are used to, we have two young children who frequently get in bed during the night and in the morning and there just was not enough space.
I will follow the advice given by Bensons and if this does not spread out I will be returning the mattress.

Saying you have to sleep on it before you can return it is ridiculous.
They could then turn round and say you can't return it because of hygiene reasons.Striving to clear the mortgage before it finishes in Dec 2028 - amount currently owed - £24,616.090 -

Hang on to those emails. You may need them to prove in court what Bensons told you.
It really would be wise to ring Consumer Direct and seek advice, as has been suggested. Bensons are doing a number on you.0 -

I have spoken to Consumer Direct and they ahve told me to send them a letter recorded delivery stating that we are not accepting the mattress under the sale of goods act.
I am really surprised at Bensons we have our previous bed and mattress form them and have had no problems.
I also think it is ridiculous to suggest that you have to sleep on it to spread it out, it should be delivered in the condition described as per the contract i.e 150cm.:mad:
If I order a size 12 skirt and it is 2 inches shorter around the waist than expected I would return it nobody would suggest that I wear it and stretch it out first!!!0 -

There are a number of threads on MSE complaining about Bensons, and their poor customer service. And also the fact that they refuse to let you cancel an order even on the same day you placed it.
I have warned about the Sleep to Live gimmick on other threads. Their computerised system is simply a gimmick to charge way over the top for a mattress.
A king size mattress is 5' (152cm) or 150cm depending on who makes it. However upholstery is not precision engineering, so you should expect it to vary by up to a maximum of 3cm. Unless it is a very pooly made mattress, and the insides collapse, then it won't grow by 6cm by sleeping on it.
If you can get one I would get a refund and buy on line where you can get far better quality for far less money. By the way, before you go back to your previous brand, do a search for them in the MSE forums.
Before you do go to another store to buy a replacement, I should point out that in the same group as Bensons are Harveys, Sleepmasters, The Bed Shed, Cargo, Factory Shack, and Relyon.
If I were you I'd stay well away from big chains and big brands.0
