T-mobile default

Hi all,

Yet another thread by me about mobile phone contracts (NEVER AGAIN I TELL YOU). Anyway heres what it states on my credit report with callcredit:
  • Name:***********
  • Account Address:********
  • Date of Birth://<LI class=bg>Provider:T-Mobile
  • Account Type:Telecommunications Supplier<LI class=bg>Account Number:*********
  • Account Status: Default <LI class=bg>Date Updated:01/10/2009
  • Account Start Date:14/02/2007<LI class=bg>Account End Date:--
  • Account Opening Balance:--<LI class=bg>Regular Payment Amount:--
  • Repayment Frequency:Monthly
  • Default Date:10/11/2007
Now what I am wondering is, as I have never received any DEFAULT NOTICE from T-mobile regarding this account. Where do I stand in getting this removed from my credit report?

I mean there is no money owed as it states on my credit report, so what can I do?

    Did you ever miss any payments, if u miss one they can place a default, although usually they wait until the account is closed and passed to a debt collector.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

  • what if they pass the debt onto a debt collector and then the debt gets passed back to the original debtor e.g. t-mobile passed it onto moorcroft and then moorcroft passed it back to t-mobile as they couldnt collect debt??

    Debt collectors don't place defaults, if T-Mobile have passed it onto a DCA it would mean they were not happy with your responses to their requests for payment, so closed your account and placed a default.
    Passing the debt around doesn't make any difference, it can be updated, but the start date will always remain the same.

    Under an experian credit report, you will probably find an 8 in payment history
    The account is in default. You failed to keep to your credit agreement and have not responded satisfactorily to requests to put your account in order, so the credit agreement has ended.

    So i assume you are aware of a debt in your name with t-mobile that Moorcroft failed to collect?

    If you believe this debt is in error, send T-Mobile the prove it letter. If they cant prove the debt exists they should remove the default relating to it.

  • Yes I am aware of the debt I have with t-mobile, I didnt pay them for a while and told them at the time why I wouldnt be paying (lost job, so had to pay them back payments) they understood this and they was fine with the agreement.

    Next minute I find moorcroft chasing me for the t-mobile debt, but iwasnt going to pay them so i just held out.

    Yesterday I found out that moorcroft passed the debt back to t-mobile.

    Now t-mobile are happy for me to pay them direct, but I was wondering what I could do about the deafult on my credit report? I thought that mobile phone companies didnt apply to the cca and they shouldnt be putting defaults onto credit reports??

  • I just re-read your reply, you say that DEBT COLLECTORS can not put DEFAULTS onto accounts.

    The reason I ask is, LOWELL FINANCIAL LTD are collecting a debt on behalf of shop direct. Now on my credit report it says lowell financial ltd - DEFAULT.

    Is there anything I can do about this? , I am paying LOWELL the debt as it is only a small debt £196, I am quite happy and am paying the debt back at £20 a month.

    What I am trying to say is, if SHOP DIRECT passed the debt onto LOWELL, why is LOWELL the ones that are showing on my credit report and not shop direct?

    I do not think mobile phones are under the CCA 1974 or 2006, but they can place defaults for debts if you fail to make your contracual minimum payments.

    T-Mobile are within there right to place a default if you miss any of your contractual payments, although they usually allow some leeway such as a 1 months direct debit failed for some reason. From what you have said, you did miss payments and a debt occurred, so they are within there right to place a default and pass it to a DCA.
    Even if you and T-Mobile came to an informal arrangement of payments, it would have been below your contractually arranged monthly payments.

    Is your phone contract with T-Mobile still ongoing, i would have expected they would probably close the account for non-payment.


    Edit for the above - DCA's cannot place defaults, but they can update them. If they have brought the debt they can place it in there name, but the default placed date, must not be changed.

    In rethinking i am sure DCAs cannot place defaults, as defaults are for breaking your contract, and as contracts are with the original creditor not a DCA, it makes no sense they can place them.

    Im pretty sure im correct on the above info.

  • No the t-mobile contract has ended, ceased by them and rightly so. I have no diagreement about that at all.

    I was jsu wondering if I could sort out the default on my credit report, the guy I was speaking to on the phone was quite helpful and said if I pay the debt account and it is cleared then they will talk to me about sorting out my credit report, just dont know what their meaning of ' sort it out' means.

    What they will probably do is once the debt has been settled, the default will be updated rather than removed (as it was placed with a valid reason). It will say satisfied so it has less of an effect on your credit file.

    Incase you didnt know, defaults as with anything will stay on the report for 6 years, so that default will drop off in 10/11/2013

    Im sure one of the more knowledgeable posters will beable to confirm.

    See what I mean, its very strange that they are changing the crdit report and not shop direct.

  • Ah I see 2013 you say for the t-mobile default to dissapear, thats better then it saying defaulted I guess if they do change it to satisfied once the debt is cleared.

    If I got all my DEFAULTS to say SATISFIED would that make a difference to my credit report if say I was looking for a loan? Would it make it more likely that I would get the loan?

    Whats the difference between SATISFIED and SETTLED?
