    BTW, I agree you are unlawful tenants but was just wondering what the legal stance was on this? It would be good if a tenant could just leave the property without giving notice or completing their contract, if the landlord failed to have their lenders permission to let.


    I spoke to our letting agents who said because of the circumstances, as long as we gave written notice we could leave whenever we liked. I think they've conceded the fact too that the LL has no intention of returning to the UK.

    You can leave when you like, but the question is to what date will you owe rent? You said your fixed term ends February next year. What I'd be wanting from the agent is written confirmation that I can leave whenever I liked AND that my liability to pay rent will end on the day I leave. A phone call would not suffice as when the chips are down agents have a way of "forgetting" such conversations.

    You might do better asking that question on the Benefits forums of this site. They have posters on there that know the ins and outs of what can and can't be claimed.

    RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

  • So I've moved...Waiting on the deposit being returned. I owed arrears on the rent previously. The LA have told me that they will not release the full deposit and will take the arrears from the deposit. Are they allowed to do this? I mean I've got to finish paying off the current LL deposit because he was kind enough and acknowledged our previous situation that was not our fault. Can a LA refuse to give out the full deposit if the tenant is in arrears? When we were in the property the LA said to pay as much back as you can, when you can. Why should this change because we're no longer living there....through no fault of our own. Wonder where the arrears will go??

    that is exactly what a deposit is for - that and for repairs to damages tenants may have caused

    If you are on benefits then apply for a Community care grant or budget loan.

    yes - you lived there, you had the benefit of a home - you should have paid rent while you lived there - when did you get into arrears and why ?
