Update From The Rotten EGG folk.

They have wrote back saying that during the online application i was presented with a Yes or NO option to which i selected Yes (This i cannot Recall) and they say it is my responsibility to make sure i have selected what was appropriate for my needs. Hmm!!

I have asked for the online screen shots of this and they have not provided me with any images where i have selected this.

They have also listed the Distance Selling Regulations in detail.

They are still sating they cannot uphold my claim or complaint and if dissatisfied got the FOS.

Do you think i should go to FOS? Any help would be great.

    Thanks

    Hi SHEEP.

    The usual fob off then?

    Yes go to the FOS.

Did you actually request a Subject Access Request (SAR) from them?
Where they should supply everything they hold on your account?

It may be a good idea if you've not done this if you want to request for this, even though now your going to the FOS hopefully some useful info may come back with the SAR that could help your case where you can send this info on to the FOS when it arrives back, you can still continue to take your case to the FOS, then once they have passed your case on to the adjudicator, you can then pass on anything that came back from the SAR to them if you think it would help you.

For more on the SAR here:
    http://forums.moneysavingexpert.com/showthread.html?t=1475553
They have up to 40 days to comply to this, but a payment of £10 payable in cheque or postal order must be enclosed, and post by recorded delivery.
That's if only if you want to request for this.

For the FOS, you can ring them to arrange they send you a complaints form, or you can download and print from their website, remember to enclose a copy of the letter you received from the bank.

Good luck with this SHEEP and please keep us posted.;)

    Your welcome.;)

Still continue to send your complaint to the FOS though, anything useful that comes back within the SAR can be sent in later - when your case is passed on to the adjudicator.
    Good luck.

    Hi,
Just an update to keep you informed.

I have just sent a letter to the FOS explaining my situation with the "Rotten Egg" and filling out the required complaints form.

I have also sent the SAR forms also.

I have been looking through the screen shot on my supposed online application and at the bottom of the picture it has an accept or decline button to proceed, but to the left pf the button it has boxes that are blanked out with things like Credit Score etc, now i know for sure that this is something i would have remembered seeing should i had been presented with this option.

I think they are a joke. trying to fob me off with bits of paper that mean nothing. Grrrrrr:mad:

    Thanks

    Hello Folks,

    Just an uodate.

Claim number one with the Halifax has gone well and they have offered just over 2000 (Which i have agreed to take) so pleased with that one.

Claim number two...The EGG Folk Hmmm.
My last post i said i would contact the the FOS, this was done on the 10th November 09.

I applied for and received my DSIR documents from EGG.
Having looked through the documents of various screen shots i can find no check boxes that i have ticked or even presented on screen. I have called them numerous times to provide me with the relevant images but no joy.

I called the FOS today and they have told me to send any further documentation to suport my claim. EGG is now aware of my claim and will not talk to me any more .

I will keep you updated as the weeks go by.

    Thanks
    SHEEP
