IVA terminated & now being chased by solicitors for a debt that I don't recognise
Hi can anyone please help me..my IVA was terminated about 18 months ago as i could not afford the repayments, since then I havent heard anything but over the last month I've been getting letter from Fairfax Solicitors saying I owe about 2 grand for a barclaycard, Ive never had a barclaycard but I dont know if maybe they are the mother company for something else I have had in the past, all my debt now is at least 5 years old and this is the only debt collector that has been in touch since my IVA failed...should I make contact and arrange to pay? Can i ask for proof that the debt is mine? Will this open the floodgates for everyone else?...what Options do I have?? Thank you in advance

What other cards did you have?
I know that Morgan Stanley/Golfish cards have been taken over by Barclays.

I would right back and tell them you've never had a Barclaycard. If they going to write to you and say you owe 2 grand, the least they can do it give you details of the account ie account number.
Be sure to word it in such a way as not to admit liability to the debt, something along the lines of "I have never had a Barclaycard, however, if you still believe this is a debt I owe, please provide documentary evidence of the account".0 -
How come they haven't been in touch with you if you still owe money??

I dont know, thats why Im so reluctant to get in touch..There were big companies that I must still owe money to such as Black Horse Finance and Ive heard nothing from the likes of these at all...0

I have dug out my old paperwork to do with my IVA and I have definitely never had a Barclaycard, the only 2 credit cards listed was a Capital One with a balance of £381 and a Monument card with a balance of £694..but Fairfax are chasing me for £3313.22 stating the original creditor as Barclays Bank plc t/a Barclaycard (but I've seriously never had one as my credit has pretty much always been awful and I'd never have got one even if i tried) Should I write to them? If so how should i word it??

the monument card was taken over by Barclaycard (look at cardtart.com for info) & so my guess is that this is what they're referring to. I'd advise contacting them to sort out a reasonable payment plan.0

The balance on my Monument card at the time of starting my IVA was £694, they are saying I owe £3312.22 ?? How can this be the same debt ??0

Make them prove it.

Thanks Fermi, I will send a letter off today... Looking into it further though it does appear to be the same card, but Im very interested to know how it can jump from £694 to £3312.22 without any prior contact before these letters from Fairfax Solicitors0

Its coming up to 2 weeks since I posted this letter and to date I have heard nothing at all...what is my next step?0
