Fraud on my current account
Comments

When cards are cloned (as has happened to me recently) the fraudulent transactions nearly always happen away from your locality. When the "fraudulent" transactions are local then the bank is always suspicious. In most of these cases it is the customer trying it on or a family member or friend using the card.
Were the transactions local?I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
I suppose you could say they were local within 10 - 15 miles of where the card was swallowed.
I suppose if I could prove I was at work - I have to clock in - that will surely help.0 -
The letter that you got from Natwest that said that they will not be refunding you presumably also had a section on how to appeal their decision?
I suggest that you go down this route.
Make clear to them of the timings. Your card was swallowed at 7.30am. The audit log for the ATM (which will be held by Barclays) will confirm this. Hence, it is impossible for the same card to have been used at around 9.00am. Once Barclays confirm to Natwest that your card was in their possession from 7.30am onwards, the case becomes fairly clearly in your favour.0 -
ml1682 it sounds as if you've fallen foul of an old and tried scam which goes by the name of the Lebanese Loop (click here for info).
You'll need to go down the Financial Ombudsman Route to reclaim your funds. Be prepared for it to take a while.
You will aslo find a lot of useful information from a legal perspective by clicking here. (Make sure you scroll down to the bottom of the page - How can I help).
The Industry themselves can't guarantee PIN security (click here for the latest), so how they can hold anyone liabile (without absolute proof) for being careless with their PIN beats me.
Hope this helps - Good luck0 -
rb10 - Natwest are saying that they do not believe it was a clone card and together with having the pin it was not fraud. They have not said I could appeal against their decision.
I have taken it up again with Natwest who have said that it will be a further 10 working days. No-one wanted to talk to me or give me any information and when I asked to talk to a supervisor I was told categorically I could not.
As far as Barclays are concerned, when I went there the same morning it happened they said the card had been destroyed. Would they have a record of my 'failed' transaction if the Lebanese loop method had been used and my card hadn't been swallowed in the true sense.
James - I had not heard of the Lebanese loop but it seems incredibly similar to what happen to the card. I will certainly bring it to Natwest's attention. Thank you.0 -
What a surprise. Two days after I posted on this forum I received a letter from Natwest Customer Services stating that they had investigated my 'concern' and they were to refund the money stolen from my account. No mention of why they had changed their mind but I am delighted.
I still feel put out that if I hadn't continued to make a fuss, phone calls etc. that they would have just left me out of pocket.
So I just wanted to let everyone know the good news and advise anyone who is in my position to challenge the banks - it is obvious that they didn't get in right the first time!!!!

Thats excellent news!! :beer:I spent 25 years in the mobile industry, from 1994 to 2019. Worked for indies as well as the big networks, in their stores also in contact centres. I also hold a degree in telecoms engineering so I like to think I know what I’m talking about 😂0
