getting our deposit back after renting (through DPS) Advice needed

Hi, we have recently moved to a new flat which we are renting. We were also renting previously and are still waiting for our deposit back from our old house...its been 5 weeks now. I know they need to make a couple of deductions from it and the estate agent knew this before we left but we are still waiting. I know the estate agent has been trying to get hold of the landlord through leaving messages and letters but he hasn't responded. Is there a specific amount of time which has to pass before the deposit gets released anyway from the DPS, and what rights do i have? Cheers MSE's
