Distance Selling Regulations + Ticketmaster

Do these actually apply for Ticketmaster? I bought some tickets which I no longer need and can't see myself being able to sell them either so I sent an email to TM asking for a refund under the DSR.
Their reply was as follows:
"Thank you for your email.
Under Section 10 of the Distance Selling Regulations, a customer has a "right to cancel", however this section does not apply to Ticketmaster. This is due to Section 6 of the Regulations which state that "Regs 7 to 19(1) do not apply to "contracts for the provision of leisure services where the supplier undertakes, when the contract is concluded, to provide these services on a specific date or within a specific period".
Ticketmaster's policy is that once a booking has been confirmed, it cannot be exchanged or refunded unless the event is cancelled, which is made clear at the time of booking. Therefore, on this occasion, we are unfortunately unable to assist you with your request.
I apologise I am unable to assist you any further in this matter and assure you of our best intentions at all times."
Does anyone have anything I could send back to them in return?

I don tthink there is anything you can do as it does appear they are exempt from DSR.
Have you tried to sell the ticekts onwards via ebay or seatwave? Bit more hassle for you i know but you will at least get youor money back.one of the famous 50 -
Nope, Ticketmaster are correct, you're stuck with them...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Yeah, guess it eBay for them a little closer to the time of the concert. Just more annoyed about having the money tied up for now.0 -
