But what about disabled people who don't have a blue badge? Asda has a duty to ensure that disabled people (not solely blue badge holders) have access to suitable parking under the DDA. By limiting the use of their spaces to blue badges holders are they not discriminating against disabled persons who don't have one?

I agree with you. Other disabled people (e.g. foreign disabled visitors and disabled people who happen not to have a Blue badge) still have to be accommodated for by retailers and service-providers, under the DDA.

One could not assume that there would always be a suitable 'empty' space near to the shop every day for a disabled 'non BB holder' to use, so IMHO they are discriminating against other people who fit the DDA definition of disability. If you google that definition it's very clear and does not include 'having a blue badge'.

I wrote a letter to Sainsburys HO recently making that very point. Haven't had a reply yet but maybe gave their overpaid top brass something to mull over (their 'Blue Badge only' signs were a bit different though as their car park I saw was being 'policed' by EuroCrapParks).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is now very easy to do in Scotland and I think the rest of the UK will follow suit very soon.

It passes the enforcement of disabled parking to the LA. As the LA will have ajudged the validity of each disabled parking bay, then the supermarket will have no liability under the DDA as far as parking is concerned to non blue bagde holders AFAIK.

  • A tesco down the road from me is doing this, only I thnk the council actually owns the car park although I don't know if they have always owned it or if Tesco sold it to them to allow them to do this.
