WTC & Disabled son - I am going bonkers!

well ds who is 19 and has ASD and semantic pragmatic language disorder ( difficulty processing language and taking words literally) and is in receipt of DLA got himself a little job - ideal for him - working within a company that offers a variety of health projects to people with learning difficulties
it's a very supportive environment for a 1st job and we are all delighted.
of course, he has quit college to start the job and I have lost my CTC ( about £400 per month) but even so - we are all thrilled for him
we were advised by the Disability Employment service to claim for WTC as he works over 16 hours per week and is disabled.
I was granted permission by the DWP to be his appointee in 2006 - meaning I could act on his behalf with people like the DWP and DLA etc etc.
so I phoned HMRC to ask for an APPLICATION FORM to help him complete for WTC - I got through and the young lady asked me for the NI number
duly gave it her and she said what name is it
told her and she said is your son there I need to go through security with him.
I said actually I am his appointee and you can ask me the questions
No - I need to speak to him
I said - sorry he is autistic and has a communication disorder and won't speak on the phone - can you just send the form.
No - I don't know that you're his appointee until you complete the section on the back of the claim form - have you done that?
err - No - thats what I am phoning for - a claim form
sorry- can't send you one unless he answers security questions due to the data protection act

i give up - how can some people claim for 19 children they don't have - but my boy who would be catatonic with fear if asked to speak to someone from HMRC on the phone, be denied the chance to claim for a bit of money to make his wages up !!!!!
it;s just as well me and his dad don't mind subsidising him a bit longer!
sorry for the rant...........but sometimes red tape is just TOO much

Write a letter to the Tax Office - as if it is from your son, "giving" you authority to speak on his behalf. Get your son to sign it and then send it in. They will then deal with you.
I've had to do this for my OH .....his memory span is so short that he forgets what the question is before he has a chance to answer .....and because he "speaks so nicely" people on the other end of the line think he is winding them up!0 -
I would go down to your local tax office and explain everything to them and take documentaion along with you.*SIGH*

nothing......... I was just remarking on the fact that only the British could make something as simple as asking for a claim form to be sent out so difficult - pardon me for attempting a little tongue in cheek humour about how ludicrous the situation was that they wanted to speak to a person with a communication disorder in order to send out a claim form
apologies if my attempt at humour upset anyone, I didn't realise we weren't even allowed to pass comment on the quirkiness that makes Britain Great :rolleyes:0 -
Nothing to do with DLA but it reminded me of the time I rang British Gas to ask how much it would be to connect to gas (no pipes to house) - they said they couldn't quote me until I had a gas boiler/central heating - to which I replied I wasn't getting a boiler/central heating until I knew how much the connection would be - and so it went round in circles....
Re your son - I think it's great he's got himself a job, try the website mentioned by another poster and persevere...Payment a day challenge: £236.69

You may be his appointee for DWP matters but not for HMRC matters. If he has had no dealings with TCO they will have no record of someone dealing with matters on his behalf.
Could your son give his Nino, Name, DOB & Address? That is all that is required before he can pass the call to you. You can then deal with the questions that will be asked regarding eligibility. If not you can ask DWP to call on his behalf as they can call on a special number so that they can speak on his behalf to request the pack. You are best to be with the DWP adviser as questions would need to be answered.0 -
I've just gone round in circles with the LHA for rehousing.. woman i spoke to didn't believe i had a son, then when i told her i had, she said, oh but he doesn't live with you, i told her he did, oh well youll need to prove that.. ok i said..
the best option we could agree on was an online bankstatement with chb showing somewhere on there..
I told her it would only have my name on there, but clearly marked would be a weekly payment of child benefit... she accepted this..
a week ago she left a message telling me she refuses to accept this as it does not have my address on.. regardless that it has my name and clearly shows child benefit as she asked..
been round and round the houses today with LHA, who finally agreed that resqueting evidence that they will turn down is a waste of time for them as well as me.
But decided that if i have kicked up that much fuss then i must be telling the truth and really do have a child.
Then after all that i was asked if i had housing/tax benefit.. yes i said.. ohhh well we have all the information we need then, if they know you have a child it must be true...

I understand that I will have to prove I am an appointee for HMRC - I have no problem with that at all - all I wanted was to obtain the claim form in the first instance.
Sadly my son wouldn't be able to give those details over the phone - he has ahd a mobile phone for 5 years and NEVER made a call on it - he listens to music on it !
I didn't know about contacting DWP to ask them to phone for me - but I have to say, that it seems a LOT of extra work for people to do when all we required was a calim form - surely if a person has been made an appointee it would make sense for those details to be recorded against the persons NI number?
The TCO do KNOW he is on high rate DLA - they only just stopped paying ctc for him on 27th september - couldn't they have cross referenced my ctc claim with his NI number and noted that he was on high rate DLA and called DWP or DLA to confirm?
it just seems a shame that things have to be made so difficult for the very people the money is there to help - and little or no provision being made for people with communication difficulties under the DDA

AS I would be in the same position as the OP, I followed the Link provided by DMG.
It quite clearly states that you are an Appointee
if you've been appointed to act for someone else - called a claimant - by one or more of the following:
The DWP is listed there.
I just wonder if the DWP does not notify HMRC if a parent is appointed to act on behalf of a young person.
It should be the case, as the DWP visit is by a person acting on behalf of the Secretary of State.
My son would not be able to conform his details on the phone, and would instantly become very agitated if I even mentioned trying to make a phone call with him.
I've jut come up against the same walls trying to sort out my son's Adult Learning Grant. I forgot about being his Appointee, so I will try to remember that next time.
I hope you manage to get somewhere, although I sort of feel the answer must lie with the DWP, and how they pass on the information to other government departments,

Thanks Munchie - just glad that someone else can see the irony of the situation
I got so angry on the phone because they started quoting the Data protection act etc- well if they have no data on my son - then clearly the DP act is not relevent
I told them I was putting the phone down to call my MP and the National Press to tell people how the system was letting my son down
funilly enough they said they would send a form - I will wait and see if it arrives
and keep you posted!
