in Credit cards
Hello - Firstly I will apologise for the long tale to follow!!
After a number of years of living on cards - and spending without thinking I had a eureka moment (along with my other half) We are determined to get rid of our bills and just spend what we have and save for what we need.
I have made a start in sorting out my finances. Doing own informal sort of DMP using resources from here and CCCS. I have written to all credit cards offering reduced payment for short term (I am in process of selling some assets will hopefully receive proceeds from this by January - some delays at moment - and will be able to clear backlog of debts then and will keep chipping away after that)
However - that doesn't help me at the moment. I have been struggling along for last 12 months and have realised have to keep money aside for essentials (mortgage, utility bills - food for children - stuff like that).
I have written numerous letters to credit cards last 3 months explaining situation - also have registered complaints with them about telephone harasssment - and am now only corresponding in writing - still gettin some calls but not as many - I have told them amount I can pay each month and date I will pay it on and I have stuck exactly to this. I have even paid small additional amounts when able.
I received 2 letters from MBNA today . The first tells me that they are looking into my complaint about telephone harassment and hope to get back to me within 28 dyas. The next letter from MBNA I was shocked to receive as it said that despite their offers to help me!! they now have no option but to cancel the card and will be sending a default notice demanding full repayment. This is amazing as I have been sending them on average 3 letters a week reiterating that I am willing to pay but unable to pay full amount each month. I have sent all these by recorded delivery so they definitely have them. What do I do now?? I cannot pay in full. Do I just keep paying the amounts I have offered or is there another course of action I should be taking? All helpful advice very welcome. Thank RON (Da doo Ron Ron)

I have had exactly the same response from MBNA. Have they frozen your interest and charges? Report them to the Ombudsman Service.Happiness is wanting what you have, not having what you want.

My pennies worth is dont make any extra payments as the crediters will think you have more money to give then on a regular basies and will hassle you for more and more.Debt free and plan on staying that way!!!!0

I have had all the same problems with MBNA including the telephone harassement. I wrote to them to ask them not to call my home number as my husband was recouperating at home after having a stroke(I sent sick notes as proof) and I was not there as I was at work and they had my mobile number.
I got a letter back basically saying tough, we will still call. They told me they would sell on the debt as I was not paying enough, despite having copies of all income and expenditure and their operator saying that in his opinion I could not pay any more, but it was not his decision.
I then received court papers, I put in a defence as I don't agree that I should have to pay court charges on top, when I'm still paying and they have sent another letter saying I should drop my defence as it will only cost me more.
How can MBNA get away with treating people like this?:A0 -
Thanks for all replies to my message - and glad (in a strange way) to know that it is not just me having these problems.
I still don't know what to do next. I want to pay and am paying set amount each month on time - but it is a reduced payment. I have this morning received letter from an agency who say they are working on behalf of MBNA and that they want me to pay them direct. I have drafted letter saying I will only deal with MBNA and only in writng.
I don't understand the threads I keep reading about applying for CCA (? is this credit card agreement?) Does this apply to me?
If anybody can suggest what next move should be it would be great.
thanks0
