Puahchair problem - please help!

Have just been advised to ask here by a friend as she says you are all fab and knowledgeable! I didn;t even know this site was here - doh!

Anyway, back to the pushchair problem in hand - it is quite long sorry! I bought a pushchair brand new from an e bay shop on a 'buy it now' arrangement in January this year. In August, this pushchair literally fell apart - the handlebar came off and the chassis collapsed - luckily my daughter was not injured! I contacted the retailer explaining that in my opinion this pushchair was not 'fit for purpose' as it had only lasted 8 months and that I did NOT want a repair as I felt it was dangerous. there is no way I am putting my DD in this make of pushchair again. The retailer had the pushchair collected and said she would pass my comments on to the maufactuers about not wanting a repair (think she was lying tbh!). There was no replacement offered while mine was away and absolutely no communication from her - grrrrrr! Then, one day, this hideous death trap arrived back at my house (wish I had refused delivery but I thought it was something else!) having been repaired!!!!!! It has been repaired so now has 2 new wheels and 2 old ones - looks rediculous!! I cannot believe that they have done this - they surely cannot expect me to use this pushchair again after it falling apart last time! My argument was that it wasn't a fault with MY pushchair but that it was the design of the pushchair in general making it so crap! Am i definitely not entitiled to a refund?

Anyhow since a replacement was not offered and I received no communication from the lovely seller (not!) I had to go and buy a new pushchair after a week as it was seriously doing my head in! My daughter had just turned 1, weighed a ton and I couldn't lump her around anymore! Her comments on this are basically tough! Can I not force her to pay for my new pushchair? I now have my new pushchair plus the deathtrap in my house which I will NEVER use again - I WILL NOT put my daughters safety at risk.

  • If a fault develops within the first 6 months of purchase then the onus is on the seller to prove that the fault was not inherent at the time. If the fault develops after this time then the onus is on the buyer to prove the fault was not inherent at time of sale which sadly puts you in that timeframe. Unfortunately, Sale of Goods Act does allow the seller to offer a repair but as far as I am aware that repair should make the item good again (ie not with odd wheels). You do not have an automatic right to a refund. If the pushchair was purchased via ebay then it is possible that the seller isn't an authorised reseller but you could try the manufacturer, other than that, ring Consumer Direct and find out what they can advise.

    The company are well within their rights to insist on a repair if it is financially viable for them.

    You dont so which pushchair it is - have you looked online to see if many other people have experienced problems too? To see whether its a common fault ( likely to re-occur again?)
