Ending my tenancy agreement 12 month contract

hi im wondering if its possible to end my contract with my landlord who ive signed a 12month contract and the tenancy ends may 2010 i cant find no writing that says i cant im really confused:confused:

    Unless there is a break-clause or notice period in it, then it is at your landlord's discretion and if the landlord gives consent for an early end to it, it is common for them to insist the outgoing tenant pays rent until the new tenant moves in and to pick up expenses, such as advertising costs, for the new let.

    you have signed for a fixed period until may 2010. you have agreed to pay the rent for the full period. If you want to leave early, your LL does not have to agree. If he does, he is entitled to claim his costs to find a new tenant. You will almost certainly lose your deposit for him to do this.
  • my mate said that the LL cant do nothing if i leave he said to post the keys through the door and leave the rent (dont pay it) and the most the LL can do is take me to court and once through court agree to pay so much p/w until remainder is paid im not to sure though i need to get out and the LL isnt a very nice one , we have a combi-boiler and hot water doesnt work unless you turn both the heating on and hot water together and then turn thermostat full blast (as you could imagine it gets very hot) i asked him on the phone to sort it told him its probably just a fuse thats gone but i dont know, anyway he told me to fix it.
    The LL has also refused to fix the front door to the property - i dont think its too bad but my inlaws said anyone could easily break in.
  • Taking you to court for defaulting on a contractual obligation and getting a judgement against you is not "nothing". It could wreck your credit record for quite a long time. It all depends on whether you want to risk this. I certainly wouldn't

    Ask the LL again if he can fix it as you don't know about things like that nd wouldn't know where to start. That's HIS responsibility to fix not YOURS.

    your mate can afford to be casual about your obligation since he isn't on the tenancy agreement that can lead you to have a CCJ against your name and whose poor credit rating and poor landlord references will cause you all sorts of havoc in the future.

    contact Shelter to understand your position rather than relying on your mate. they can tell you how to get the repairs done. their site is very informative about your options and your responsibilities for the fixed term contract.

    Have you put your complaints about the property into writing and sent the letter recorded delivery? This is the correct method of reporting faults with the property, if no action is taken you then speak to the local council or Shelter. If you are stupid enough to take your mate's advice and end up in court, the judge will want to see proof that you reported problems with the property - a letter and recorded delivery slip.

    A CCJ affects your credit report for six years after the date it is settled (paid off in full) and you will have to pay all the court costs as well as the rent for the remainder of the twelve month tenancy. If you are really lucky a bailiff will be appointed, and you will lose your car/ flatscreen TV/ games console.
