    Check your facts carefully before you do anything. Get a copy of this application/plans and compare it with what it appears they are doing. It may have been refused this permission, had the plans changed to fit the permitted development rules and thus now not need it.

    Are they having an extension as well as the loft conversion? That may have taken them over the permitted development's size rules so they've scrapped that and settled for the loft only. My sister did something similar, 3 or 4 years ago.

    An application for a Lawful Development Certificate is not a planning application. It's basically asking the formal question 'do I need planning permission for this or is it permitted development?' As it was refused, the dormer proposed at that time obviously needed planning permission. Have they since submitted a planning application? Or maybe, like someone else said above, they have reduced the size of the dormer so that it now is permitted development and does not need planning permission.

    Most rear dormers are in fact PD (unless the roof has been previosuly extended by quite a bit, or the house is in a conservation area, AONB or National park).
