iva/blair endersby

hi ive recently entered an iva, blair endersby ,i pay £160 pounds a month ive been with them about 3 months. just this month they took 2 payments out of my bank and drawed me in the red ,they said it was an arrangement fee but they can add it onto the end of the term instead and refund my 160 back into my bank, they did not notify me that they where taking 2 payments and now ive got daily bank charges adding up, i asked them if they where going to pay my bank charges, they said they would see what they could do but wherent promising...next month if they dont pay my bank charges, i wont be able to afford both B/E payment and bank charges too....surely they have to sort this out ,they got me into the mess,and they are supposed to be helping clear my debts not get me into more debt....whats your thoughts.....thanks ....ade

    They really shoud sort this out but wait and see!

    Incredible that they would work out your monthly affordable contributions and then think that it's ok to take two payments! (You can afford £160, but this month we think you can afford £320). Perhaps if they dont sort it out, their regulators might like to know about this - mentioning it to them might be an idea IF THEY DONT SORT IT OUT!

    1. No company really should be charging a set up fee - they get a set up fee anyway, it's called a nominee fee!
    2. If they are taking an up front payment it should be taken long before the IVA is agreed and started... but then that means they are delaying you getting into your solution until you can afford the payment!

  • hi charco, they did take £50 in august and a further £110 in september before it was even passed through the courts, would that be the fee your on about, if so im disgusted they did this, but i should hear what thier actions will be i hope today ,so if i get no joy surely i will be able to do something

    Surely they discussed an up front fee with you! Did you go directly to Blair Endersby of through Baines and Ernst - did neither of these companies discuss an extra fee?

    What they are doing with these extra fees is turning your 60 month IVA into a 61 month IVA or 62!

    It seems they are charging two months contributions as a set-up fee. This should have been discussed with you and done properly so as not to cause you bother. If they dont sort it out in a manner that is satisfactory to you then ask for address and contact details of their regulatory body - that should make them sit up and pay attention!

    Yes, Nick that's what i thought. But the person here is saying it was not discussed or made clear to them... perhaps training for some of your staff might be in line (perhaps not!)

  • got another question, i know that if you earn anything over your monthly salary you have to give 50% to the iva but... for example...what if i work over time and earn say £200 extra in a month and my exhaust falls off my car which costs me £200 i will have to use this money to repair my car to get to work....how does that work

    I send BE all my car and big bills like that, and it is supposed to be taken into consideration when they do the quaterly credit checks to see what my next years payments are going to be. Cant say Ive noticed it yet though, will go and have a look !! (im in my final year with them now - they have been fab all the way through, and very helpful with everything Ive needed help with)
