Miss sold a credit card what now

My girlfriend had to open a bank account for her wages to be paid into as it was her first ever bank account the advisor at Barclays asked if she wanted a credit card as she had never had one she foolishly said yes this was ten years ago when she was just 18 and they gave her £1500.00 limit all this the month before xmas is there any way she can get rid of this debt.:confused:

    Yes, find the most recent statement and to the bottom of the page you will find a Giro slip, fill it in, tear it off and.....well go and pay it.:rolleyes:

  • How is this mis-selling you need to read up as she has no case at all.

    The product was correct fro her personal circumstances she has not paid for anything you couldnt use.

    She was 18 and silly most lenders wont give an 18 yr old a £1500 rope straight of the bat these days. My first card was only 400 quid limit 10 years ago.

    If she still hasn't cleared the debt 10 years on then I would worry about he getting into more debt as her credit file will most likely be in pieces.

    How has she gone 10 years without paying it back?

    At 28 she will have be a grown up and pay she had the goods and services no she must pay for them.

    In what way was the card mis-sold ?

    Are you as thick as your girlfriend ?

    Oh right so because she used a credit card without considering whether or not she could afford the repayments the bank was irresponsible?

    My friend was given a credit card like this when she turned 18, she never bothered paying it for no reason other than "I can't be bothered". It defaulted and they repaid the debt via right of offset. She's now got a ruined credit report for no reason other than she "couldn't be bothered" to pay, and the debt has been repaid anyway, just without her consent.

    If your girlfriend couldn't be bothered to pay it off after a decade something must be wrong with her, I mean for crying out loud if the account defaulted (which it undoubtedly will have done) that's £3 a week to clear it in a decade.

    As proliant says, if she doesn't like having an outstanding credit card balance after all this time she needs to pay the bill. If she didn't want to have to make repayments she shouldn't have used the card in the first place!

    If she hasn't made a payment or acknowledged the debt for 6 years or more, then it is "statute barred" and cannot be enforced.

    Even if this is not the case, this is a pre-2007 debt and may be unenforceable anyway. If you try requesting the CCA it may just "go away".

    If I were Barclaycard I'd have given up a long time ago. I'm sure Barclaycard have got better things to worry about than spending a decade trying to enforce £1,500 worth of debt! :p

    And as you say, it's probably statute barred and unenforceable anyway.

    A/ No i am not as thick as her as i don't have any credit because as a sensible person i pay cash for what i need and if i cant afford it i don't need it.

    B/ Not sure about it being miss sold as i have said i personally don't ask for credit so not sure how it all works hence why im here.

    C/ Don't assume everyone is a credit card thicko as i said she was 18 irresponsible and is now coming to terms with her past mistakes again hence why im here.
