Hi, can any body please advise me if the name on a car logbook is proof of legal owner.
Can a logbook have one persons name, but be legally owned by another.
If so can you point me to any law supporting this, I have issues with Logbook loans, who took my car due to a logbook loan placed on it. I have studied the Bill of Sales Act which gives them the security on my car. It states sec 5 of the Act, contains two important provisions avoiding a Bill of Sale, "except as against the grantor," in respect of (1) personal chattels not specifically described in the scheduled;
and
(2) personal chattels specifically described therein of which the grantor was not the true owner at the date of the deed
Can any body please clarify the legal term for the following
1.Legal ownership
2. Equitable ownership.
many thanks

It is fairly easy to get a duplicate logbook. IE it doesn't necessarily prove ownership!.....0

A logbook does not prove ownership of the vehicle.
I lease a car - the logbook lists me as the registered keeper, but the car is owned by the leasing company."You were only supposed to blow the bl**dy doors off!!"0 -
So just to confirm.
You borrowed money from Logbook Loans against your vehicle. You didnt repay the loan. Logbook loans took your vehicle.
Which part of this is unreasonable? If you didnt want to lose your car you should have repaid the loan.
Nothing Illegal about you being granted a loan against your car. In essence they dont need a logbook to prove ownership as ownership passed as soon as you defaulted and they took the car.0 -
The V5C Vehicle Registration Document records the Registered Keeper of the vehicle.
This may be entirely different from the legal owner."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
It used to state on the V5 that the registered keeper is not necessarily the owner. I don't know if it still does.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0
