Help Please! Received ticket from Bradford Council - but no offence committed!

Options
HI I received a parking ticket on saturday in town for allegedly parking in a street which had restricted parking hours etc

I have taken loads of pics of the place, got witness statements and can clearly prove that no signs were displayed. this is an unmarked piece of land where 3 to 4 cars park there on a daily basis at any times of the day, i have never seen a ticket being issued to any cars

more funny was the fact that a van was parked on double yellows near to where i was and he had no ticket!

anyways whats the best way of dealing with this claim

  • Try showing the pics on here for the experts to look at, this would be a start. Photo's of all sides of all paperwork from the council would also help, you will probably have to see the TRO for the street in question, (its not a FOI request, its a public record document)don't ask for a copy, they have been known to be in error.

  • thanks but how do i obtain a TRO for the particular street>

    appreciate the help
  • i will scan my ticket, both sides and show the offence.

it states 'parked in a restricted street during prescribed hours'
indicating that parking is limited to certain hours?

but no signs at all anywhere!

You say no signs at all anywhere, but check you have not entered a restricted parking zone, which may well have signs several streets away as you entered.

Any time I have needed to do so, and baring in mind I am in Scotland where the legals are slightly different, I've gone into the council local buildings (in that area) and asked to view register of public road (usually lists TROs applicable) or just asked for TRO itself. Obtaining a copy is more complex, but you can go with a pad and make a note of what it states. A TRO is not exactly a helpful document to unless you understand it however usually states things (from memory!) like an "Y Street- From a point at it's junction with X street for length of road 40m or thereabouts" or "from a point 65m from it's junction with X street a length of road extending to 90m or thereabouts".

In England copies of a TRO should be available to any interested person. See the Local Government Act of 1972. Later legislation makes them available for inspection.

The contents of these Orders varies considerably according the skill and effort put into them by the Council.

this is the ticket issues to me and the reason given is parked in a retricted street during prescribed hours.....how am i suppose to know if there are absolutely no signs saying anything like that

i went to check the street again, and again found cars parked on same spot
  • There is a reverse to the ticket which would be of help. Photo's of the street and anything related to it would be good. Defo check the TRO.

complete with its plethora of yellow lines, white bay markings and accompanying signage?
