Who can I Sue!

We bought a new bungalow 3 years ago from a developer who employed a local builder, the builder went bust last year with £100k of county court judgements against him. At that time I developed breathing difficulties and now have COPD, this was due to mould that was caused by insufficient ventilation from the vents in the windows. The windows have been surveyed and Zurich are now going to have them all changed. The developer doesn't have third party liability insurance so can I sue the window manufacturer as he manufactured faulty goods, even though he sold them to a builder who has gone bust. When we purchased our new home the conveyancing solicitor didn't check to see if the was a local authority completion/habitation certificate, which we later found out that ours is the only home on the development without one; can we sue this solictor under his third party liability or professional indeminty insurance.
My health has suffered through no fault of my own and I need to seek compensation from someone.
All advice gratefully received.

Do you have proof that the mould is the cause of the COPD? The HSE doesn't mention mould in its page on COPD at http://www.hse.gov.uk/copd/aboutus.htm. Smoking and dusty working conditions seem to be the main culprits.0

The mould has caused my COPD, this is similar to Farmers Lung.

You may be convinced that the mould caused it but you won't be able to sue anybody successfully unless you can show good evidence (such as expert opinion) that it's true. The fact that mould isn't mentioned as a cause by either HSE or the NHS will make it harder to convince a court.0

Were the windows actually faulty or were they just the wrong windows for that environment?0

I've got two reports from Chartered Surveyors regarding the cause of the mould, as regards my health my GP has confirmed this and I'm waiting to see a Medical Expert from Premier Health. That aspect is cut and dry, but who can I sue, the window manufacturer would be best but I didn't have a contract with him although I bought a property with his products fitted. This is no different to any of the white goods in our kitchen, they came with a guarantee.

You can Sue me if you want for calling you a money grabbing toe rag!
Doesn't this bungalow have doors in it??
What about suing the company who made the letter box?
The Gas inspector should have tested for ventilation as part of the Gas Safety certificate, Sue him.
Sue yourself for not once EVER noticing...." it seems a bit stuffy in here" or "it seems a bit damp in here"
Sue your misses for not noticing either...
Sue everyone.....
Blame us all....
Jeeez.... some people!!!!Beware of imitations e.g. Robert Sterling0 -
Robert,
Would you like to have COPD and have your life shortened by 10 years plus because you are guilty of buying a retirement bungalow. The cowboy builder who went bust has done this twice in the past owing local companies some of which are one man businesses many £10000's of pounds. If you robbed the local post office of this amount of money and were caught you'd go straight to jail yet you can set up a business and con everyone, pocket the money and walk the streets freely. The business who manufactured these windows was partly run by this crook so who has sympathy for these types of low life’s.
Robert you're a sad person if you go through life with that attitude, then perhaps your one of these cowboy business low life’s who con the rest of us.

I very much doubt the windows were actually faulty; probably just the wrong windows for the building, so unless you can prove that those specific windows would be of no use in ANY type of building, then you can't sue the window company.
You could sue the developer?
Saying that, you will need clear evidence that the damp/mould and this alone has caused your COPD (and nothing else), with good evidence. Given that it's not a recognised cause of it, then this could be hard work.
Have you been through the list of known causes of COPD and ruled out every single thing on the list as having contributed to your COPD?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0
