Barclaycard Stalling / Refusing Section 75 Refund

Long story short -

Flooring Coy goes bust before job done so we need a new floor. Ask Barclaycard for Section 75 refund in March 09. They reply to register as a creditor and wait. We do and 5 months later get told by courts that there is no money (shock).

OK say we and return to Barclaycard and ask for Section 75 refund again. They say please send a lot of paperwork (we do as we have it all). They wait another 2 months then say we need an independent report done into the state of the floor and what needs to be done.

It has now been 8 months and we have had enough.

Should I go straight to a small claims procedure (£30 online) which I am tempted to do as I can claim interest going back to march or go to the ombudsman?

To my mind, Barclaycard are stalling in an attempt to get us to go away / give up.

    By the way, we have already had another flooring Coy in who said to us we need a new floor hence the reason to start the entire process.
