Help with Credit Card Fraud

Hi.

First time I've used the forum, so apologies if this scam has been subject of previous discussions, but we've run out ideas on how to resolve this.

We were tricked a couple of months ago into a scam that authorised the deduction of a couple of payments (apprx £5 in total) to work @ 4 home for Google. Gullible I know but....

To cut a long story short more unauthorised USA based deductions have continued & the credit card providier says we're liable 4 them - even if card closed. They reckon we've authorised/mandated these transactions with numerous unknown companies & can't cancel them. Provider says it's up to us 2 sort out, but how can we cancel something we never set up.

Has anyone else been able to sort this out please.

Basically, if you hand over the 16 digit number/expiry date etc. on your debit or credit card, you're trusting the payee not to set up a continuous payment authority [CPA] to withdraw more funds from your account.

Once set up, you can’t cancel a CPA. Neither can your bank or your cc provider. Only the company you've agreed to pay can do this.

If you close your bank account and/or cancel the credit card and do not notify the payee, payments will continue to be charged to the closed account(s).

As the customer, you'll have to contact the payee(s) directly and get them to stop it.
People who don't know their rights, don't actually have those rights.

Whos your credit card company? Is the card Visa or Mastercard? Did the terms and conditions state you'd be charged for further amounts after the intial first payment?

You may be able to dispute the further unauthorised charges with your credit card company. If they didn't state you'd be charged for further amounts in the T&C, then you'd have a case. There's a lot of diet and health type companies scamming people with this right now. For clarification, this is a 'Dispute' not 'Fraud', as you did participate and give the company your card details.

You need to cancel with the merchant by sending a letter or e-mail, keeping proof that you've done so. If they continue to debit your account your card issuer should be able to charge future payments back if it's a Visa card, but you will need to provide them with proof of cancellation.

Dealt with this on Sooooo many occasions. You have signed up to a CPA. continuous payment authority. The merchant will keep charging you and commonly change the description on your statement. Visa or mastercard write to your bank once you have tried to contact the merchant to cancel. Provide them with a date of your cancellation and they will chargeback the rest of the payments after your supposed cancellation date. easy as that.

From memory the merchant is pretty difficult to obtain contact details from as there are several different companies that mask themselvese as Google money making kit etc. Your origional signup email should have contact details or just go back to the site you signed up on.

    All the best

When you signed up for this did you actually read the Terms and Conditions (ie the 'small print')?

In all probability, the small print did say you were signing up for a CPA (Continuous Payment Authority) but you just failed to read it! If such Terms and Conditions were only buried in the T&Cs and not made clear when you checked out then you may have a claim in a civil court, but I guess that would be a civil court in the USA!

Of course, if there was no mention of ongoing payments anywhere (including the 'small print') that would be tantamount to fraud and your card company would be liable.

If you bank with the same institution as your credit card company be aware that your CC company can retrieve the funds direct from your bank account!

Finally, I suggest you search the internet to see if there is any official government body in the USA that may be able to assist you.
