my rights

bought a secondhand car bumper from an auction site,the item arrived damaged.The seller claims it must of been done in the post,he refuses to refund my £400 can anybody help.Ihave tried reasoning with him threatened the small claims procedure to no avail.help help.

    Did he have it insured?

    As you have threatened small claims court, you need either to follow through and be prepared to go all the way, or just drop it.

    How did you pay??

    If by creditcard [or even paypal funded by a cc] - then chargeback [within 120 days]

    IF debit card then chargeback as well

    IF more than 120 days - section 75 claim on credit card

    If western union - stuffed

    if cheque - stuffed, but you might bre able to addfy and bank from your bank but unlikely unless you go 'legal'

    cash - see western union

    Only sue if he has assets and can be traced eg does he own the house he lives in etc.

    Best route is to only every pay with a creditcard......

    If it was damaged through the post it is the sellers responsibility to claim for the damages and as it was sent through ParcelForce 24 it is covered up to £150 as standard so you could try and persue it that way.

    If you paid by Paypal then you could try and claim it back through Paypal.
