M and S Credit Card

I have written to M&S re PPI attached to acredit card I closed in 2006. They have responded refusing to repay premiums on the basis that when they changed it from a charge card to a credit card in 2003 I should have stated then I didn't want any of the terms and conditions transferring from the chargecard to the credit card they are also arguing that they were only an intermediary for the sale of PPI and as they were not a bank they were not regulated.

I don't accept this as they never asked me about PPI when the chargecard was taken out consequently how would I have known to ask them to stop this in 2003.

I guess this is a standard response. Should I persue? Any advice would be welcome

    Could you ask the FOS who to make the complaint against. I know in cases like this some are making complaints against the insurers. I would not give up on it though as like I say, if you ring the FOS they may be able to point you in the right direction.
