TUPE redundancy query

I worked for a previous company for 5 years and transferred under TUPE regulations to my current company which I've been with for another 5 years. Should I be made redundant, would my redundancy payment and notice of termination be based on the full 10 years?

  • Provided your employment has been continuous i.e. you didn't leave and then return, then yes - 10 years.

  • That's good to know - thank you

Debt free chick is bob on. Providing you didn't sign to otherwise in your contract of employment with the new company, normally TUPE contracts retain all the benefits of your previous employment small changes are made were certain services aren't availible (e.g. the new company doesn't have a dental/healthcare scheme). They almost always try and remove any final salary pensions too.
I'd check through your contract but chances are you would be entitled to the full ten years.
