Section 75 advice required.

On the 14/9/09 my wife booked me a 1 hour training flight which cost £169 from a local Flying School.(FS). This was for my birthday.
The training flight was paid for by way of an HSBC Visa Gold Credit Card, over the telephone. The next day all the documents arrived at home by post, including the payment slip for the transaction, and a voucher for a 1 hrs flight at the FS.
No date was given for the actual flight, but the flight voucher was valid for 12 months.
On the 30/09/09 we contacted the FS and booked to redeem the flight voucher at 1300hrs, Wednesday , 7/10/09 to take this flight.
We agreed that before setting off for this flight, we would contact the FS to see if it was a goer.
When we contacted the FS at 1100hrs on the day of the flight, we were told that the FS company had gone bust, and no pre booked flights would be honoured, and no money would be refunded.

After this disaster, I came on MSE and download the posting explaining how to go about submitting a Section 75 claim to the CC company.
We contacted the CC company call centre and told them we want to make a S75 claim for the loss of the flight from the FS. If would appear that the operative in India did not know what a S75 claim is, so he sent us a claim form which the CC company investigate this loss of the flight.

After much discussion with the call centre we decided to submit the CC company claim form and enclose a letter telling the Card Company, that we insist that they send us a S75 claim form, and as you say good luck with your investigation.

Can anyone inform me if CC companies do have a S75 claim form for me to submit and will it be detrimental if we submit the CC claim form, or any advice you can give us to get our brass back

    Couple of points.

    I dont know your bank but mine dont have a form as such.

    Send your bank a covering letter detailing the service you paid for and that it will not be received. you said it was valid for 12 months, Based on this they will simply charge back the payment the merchants bank and credit your account accordingly. I have dealt with a few of these for flight schools up in Scotland in the same scenario.

    Send all your supporting information such as a copy of the voucher. Details of your contact with the merchant etc basically what you have posted here. They will chargeback the transaction ( Reason code 30 from memory, im a bit rusty:P).

    Description of services paid for.
    Merchant contact in trying to resolve Non receipt of service or contact with liquidators if applicable.
    All your documentation.

    Easy as that your money back and we all go on happy :)

    I will use the templates from MSE, and amend them to fit my circumstances, and follow your good advice also.

    Do we have to fill in the claim form that the Bank sent us, or can we ignore that and just send back a covering letter claiming the protection of S75, with copies of our paper work?

    After sending the Section 75 request to the bank for breach of contract, today at 1605hrs we got call from India.
    The operator in the call centre informed us the the £ 169 was credited in our account. good job....................................
