ESA claim when partner on incapacity?

Hi everyone, can someone answer this for me.... when someone makes a new ESA claim, and there partner is already on Incapacity Benefit...does this mean the partners Incapacity will be swapped for ESA or will it stay unchanged?

Yes im disabled....yes I can do things you cant....but you can do things I cant so were equal!

You claim ESA and you partner remains on IB. His IB, assuming it is payable IB, will be taken into account on your claim for the Income Related part but will be totally disregarded for the ESA(C) part.
He will transfer over to ESA next year though as part of the migration.0 -
Thanks very much for your speedy reply, its my partner thats claiming esa but im already on long term incapacity, it asks about my disability - so shall I fill this in? or leave it blank?

You can fill it in or leave it blank, not really sure why it asks that on the form as there is nowhere to input it when processing a claim, so its not really relevant to the claim from what I can see.0

Dont fill it in unless you want them pushed on to carers allowance, thats whats happening ATM and it dosnt come into it for contributions based benefits anyway.
2010 ESA migration NASA, no chance of it happening even for the first under 25 group, they cant keep up with new claims so how can the migration begin when its taking months for claims to be sorted and everyones appealing desions?

MY partner was addmited to hospital in July and his claim has just been sorted out, he went 8 weeks without any income at all.
Hes had the medical and will probably have problems with that, hes still undergoing tests but it seems likely he has a tumor that needs treatment to make it suitable for removal along side removal of one of his kidneys. Hes very ill and could do without ESA problems.

The average where I am is 17 days. That isnt a huge amount of time IMO. From what I have heard the migration will take place in 2010. It really does seem to vary from region to region.My partners claim took around 13 days, we are in south west scotland
At the start where I am it took around 22 days - its improving all the time as people get to grips with what an integrated Contributory and Income Related benefit is like.0
