Post dated Cheques

I recently sent a post dated cheque to a company which we had been paying debt off with.
I wrote a letter with the cheque to explain it was post dated because i didn't get paid until the end of oct.

Today i have found that they have cashed it and that im overdrawn and have no money until pay day in two weeks. :mad:
I contacted the Alliance and Leicester and they told me that it wasn't their problem (they don't check all the dates) and they said i should contact the company i sent the cheque too.

They have agreed to pay my charges as it was partly their, they have told me however that the bank was partly to blame.


Is the bank in the wrong in anyway because if i could get that money refunded then it would be a great help.

Are banks allowed to process cheques without checking dates and other details?

    Yes they are
    This is an open forum, anyone can post and I just did !
  • It is in the terms and conditions of all banks who offer cheque books that you do not issue post dated cheques.

    It has been covered many time on many forums on lots of web sites.

    Do not ever ever issue post dated checks unless you have the funds to cover them when you write them.
    It is a very unreliable method and most of the time fails as you are putting yourself in the hands of people who's interests are not the same as yours.

    Hopefully you learning the hard way will be read by a few people who will learn something from it

    Neither the bank, nor the company to whom the cheque was made to are to blame.

    You aren't supposed to write post-dated cheques with the expectation that they will never be cashed before that date.

    The law says that a cheque is not made invalid simply by being post-dated.

    If you need to prevent a payment from leaving until a specific date, use internet banking to pay it manually and on time - or just mail the cheque later if you really must use a cheque.
