Unauthorised access of my credit report

Hi all new here,

Not sure if anyone can help, if this is in the right place or indeed the right topic. But if it's not the a point in the right direction would be helpful.

I looked at my credit file through Equifax yesterday. And under 'other searches' there are 3 searches by an estate agents in my home town. I have never had any dealings with these estate agents, but after a bit of digging online I was able to find out that my ex partner Is a manager at one of their offices. The searches were carried out in December 08 and then 2 on the same day in July 09

Can she do this ? She has obviously carried out a search for personal reasons using her place of works Equifax account.

One of the searches is against our old address where we lived together and she still lives at. The other is against an address I lived at after we split.

She has a ccj against me that I am disputing and not paying – does this give her a legitimate reason to run a search on me through her company account ?

Where do I go from here? What are the consequences to her?

Any help you can offer I would be grateful of.

    The first question that comes to mind -- if she has a CCJ against you, why haven't you paid it? The time to dispute it is BEFORE the judgment.

    Maybe if you paid her the money you owe, this other problem would not arise. I'm not saying she wasn't wrong to access your account but it seems like there must be two sides to the story -- and a public internet forum maybe not the best place to thrash it out.
  • Cleo - I only found out about the CCJ in September - I am happy to pay it if she can prove to me what it is made up of and her reasoning for me oweing this money. My Solicitor has informed me that if it is not going to be easy for her to substantiate the claims.
    The CCJ was also registered at an address I was no longer living at and my ex partner knew full well I was no longer there. I therefore had no chance to dispute it

    Not quite sure you understand what a "judgment" is.

    If you want to apply to set it aside, then get cracking.

    Have you informed your solicitor about her alleged "unauthorised access". Maybe he'll be able to tell you whether it's unlawful or not and maybe followed up by a strong letter to her employer.
  • I have and he is looking into it. I just really wanted to know what the situation was from Equifaxs point of view?

    Were/are you financially linked at all (joint loan, bank account, mortgage etc)? If so, would a credit check on her then give them permission to check you?

    Sometimes the credit check forms state they will search others you are linked to.

    If the checks were carried out by the firm of estate agents your ex works for, that doesn't prove she carried them out herself. The estate agents might have carried out the checks. Ring their head office and make enquiries -- or have your solicitor do so.

    Edit: Maybe your ex applied for a mortgage from the firm of estate agents she works for? Sometimes that's one of the perks of working for an estate agent -- preferential rates on mortgages. If she did, and they ran a credit check on her, then (as Newlywed said) if your files are still associated it would access your file as well as hers.
