    It's fairly amicable at this point (as amicable as a divorce can be i suppose) and as for a financial settlement oh if only i could afford one! Any guidelines on solicitors fees?

    Sorry to hear what you are going through, I'm in the middle of the same process. First off, there are no quickie divorces here, only long, drawn out, expensive ones. You need a decent Solicitor, mine is rubbish. They then engage a Barrister for the attendances at the Royal Courts of Justice. You'll draft up a divorce petition and attend for the Decree Nisi. After that comes ancillary relief, the financial arrangement and if they are sorted out of court then you can go for the decree Absolute.

    There was supposedly a cheaper route with all parties co-operating round a table, but you still have some heafty bills, sorry.

    Court Fees for the initial divorce are £200, then the initial Solicitors and Barristers fees for the court appearances will be up to £1500 I reckon. I can't answer for the Decree Absolute as I'm not there yet.

    I could recommend my Ex-Wifes solictor she was good :eek:, but she is based in a firm in Co Down, if you are interested I can PM you the solictors details...
  • My sis got one this year, had been seperated for two years exactly.

    Went to Madden and Finucane I think, they charged £600 (which she and her ex split) and it takes about four months to come through. You can keep whatever name you want :-)
  • Everything straight forward enough ?

    1 Are there children involved?
    If No then things are easer

    2 Both parties happy to divorce?
    If yes and there is no chance of this changing or becoming bitter or entrenched easer still

    3 Is there property, joint ownership of life insurance etc ?
    If yes then you need to sort this out and it is really a job for a solicitor.

    If all this can be sorted then there is an option whereby you do not need a solicitor or just a solicitor just to sort financial dealings. This will reduce costs. If this is the case, pm me if you'd prefer not to discuss on the boards or just ask here and I will talk you through the process.

    Most solicitors are free initial consult and then they start charging from the second visit.

    You can change your name to whatever you want to (ie revert to maiden name) just by writing to bank etc.

    Something along the lines of

    Dear Sirs

    as of (date ) I shall be reverting to my maiden name (name) in anticipation of my forthcoming divorce. I would be pleased if you would note this change and issue a new bank card (or whatvever) at your earliest convenience.

    Yours sincerely

    Miss (whatever name you now want)

    Formerly
    (whatever you were before)

    and sign with both signatures.

    This is the NI silliness. As I was informed there really is only one way and that is 'unreasonable behaviour'. Of course, if things are amicable, one party may agree to this just to move things along. That said, the length of the marriage has to be at least 2 years. So if you have been married one year, you have to wait another year before you can take this route; which is better than having to wait another two as would otherwise be the case. Of course if you have been married for more than 2 years then this particular route would mean that you could get the ball rolling immediately.

    Crucially - there are 5 separate grounds for divorce in Northern Ireland.

    two years separation with the consent of the other spouse to divorce
    five years separation
    unreasonable behaviour
    adultery
    desertion

    and

    A couple may not apply for divorce/dissolution of Civil Partnership within the first two years of marriage/civil partnership in Northern Ireland - unlike England and Wales where it is one year and in Scotland where there is no time limit.
