Faulty Mattress

I bought a new metal bedframe and budget mattress from Dreams in July for my two year old daughter. As I expect the mattress to get sicked and wee'd upon, I bought the budget mattress with the intention of replacing it in a few years once she's a bit older and more likely to get to the loo in time!
This is the mattress I bought:

However, within a few weeks, my daughter started saying the bed wasn't comfy and started waking at night. I lay in it and could feel the metal springs and it felt like the padding between the springs and cover had disintergrated. I turned the mattress over.
A few weeks later and the same thing has happened on the other side of the mattress and she is saying the bed is uncomfortable again and waking in the night. Again I can feel the springs sticking in me when I lay on it.
The bottom half of the mattress is fine, as due to her height, she only takes up half a mattress length.
I have phoned Dreams to complain the morning and was advised that the mattress is for occasional use only and should not be slept on every night. I did advise there was nothing on the website page to suggest this, but the lady insisted I would have been informed before ordering it was occasional use only. I wasn't and as I was intending it to be used every night, I wouldn't have proceeded if I'd been warned.
Dreams have offered two solutions:
1) replacement of the budget mattress, but I was warned the problem will probably happen again if it's used every night and no further replacement will be given.
2) I purchase a higher priced replacement mattress and they give me £49 towards the cost of it.
I don't feel either is acceptable and would be happy if they could supply a mattress that can be slept on every night at no additional cost to me, as that is what I was led to believe I was buying in the first place. Do I have any rights to expect Dreams to supply such a mattress?

The website still doesn't show any indication that the mattress is only for occasional use. Isn't that false advertising? I would take a capture of the website as it now is (in case they change it) and contact Trading Standards.
I don't know if they are obliged to provide a better mattress for no additional cost, but they should at least give you a full refund. You could get advice from Consumer Direct on whether you can demand a higher-price replacement.0 -
Not fit for purpose, reject under the Sale of goods Act, request refund within 14 days or you will start proceedings with Moneyclaimonline, job done!
Don't bother getting into a lengthy discussion with them, not worth it - no where on the site does it say that the mattress can not be used everyday.0 -
I agree with both cleo1299 and smcaul.
Make sure you do capture and print out the web page. This is what they do say (as you know):
Budget Basics Mattress
The Budget is fantastically competitively priced and features a continuous coil spring system with layers of quality, hypoallergenic fillings for additional support and comfort.
Budget models are usually the very minimum standard. So to say things like "additional support and comfort" can be very missleading.
Although budget mattresses are generally designed for occasional use, they would usually be expected to withsatand daily use by a small child.
My advice would be to do as suggested by the other two above, but insist on a refund. Then stay well away from Dreams, or any other big chain store, as most are as bad. Then buy on line from a seller who gives a satisfaction guarantee, and stay with smaller independent manufacturers. You should be able to go up a couple of models for a similar price to what you paid at Dreams. Also avoid the continuous spring system, as it is very unreliable, and go for open coil springs instead. If you do decide to spend quite a bit more, then get a breathable waterproof mattress protector, so that the mattress won't have to be changed after a year or two.0 -

I posted recently about a new mattress and Tim said the same thing to me but he DID give me some information on spring types and also advised me to go for a smaller independent manufacturer rather than one of the big brands.

It really is hard to know. I thought my present mattress was ok when I tried it in the shop but it's been a really bad choice. I've got to find a new one because it's wrecking my sleep, it's so hard.
