Not sure how to proceed?

Hi
I sold a fairly expensive item, the buyer became very difficult and so I tried to cancel the transaction. He declined to cancel, saying he did want it, so the case was closed and no FVF was given.
Two weeks later, he has still not paid and when I try to start a dispute the system is telling me I cannot as the case is closed. Anyone know how I proceed?
I have emailed ebay, and am fully expecting a robotic email with incorrect information!
Thanks for any advice

It sounds like you gave him the option to continue, aka a mutual dispute. As he said he still wanted the item, the dispute obvious wasn't mutual. The fact that he then failed to pay is unfortunate for you, but there's not a lot you can do about it, as you only get one go at a dispute. My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

No, I didn't go for a mutual dispute, it offered me the chance to cancel the transaction and to give my reasons, which I did.DEBT FREE since 2011

There is only two options, one is a full NPB the other is known as a mutual (although they don't use that wording)
Only a full NPB which you can do from 7 days after auction ends guarantees you your FVFs back, the other options basically asks the buyer if they agree that you have decided to cancel the transaction. If the buyer says that they do not agree then the transaction stands, which is a bit daft as you no longer have nay way at all of making buyer pay.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Here's the link that may help:
http://pages.ebay.co.uk/help/sell/cancel-transaction-process.html
To receive a credit on your Final Value Fee, you'll need the buyer to agree to cancel the transaction. Contact your buyer and ask him or her to agree to cancel the transaction and let them know they'll be getting a note from eBay to start the process. Here are some tips for communicating with your buyer.
then further on where it tells you how to do it it says again:
If the buyer agrees to cancel, your Final Value Fee will be credited to your account.
So sorry, but by not waiting the 7 full days and doing a full NPB the buyer has cost you even more money.
Never ever do a mutual unless it really is a mutual. A buyer who is daft enough to bid and win an item and refuse to pay is too dim to work out how to agree to a mutual.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
