Problem with an eBay seller.

Hi, I hope someone can help. I bought a pair of tyres of eBay in Aug of this year, unfortunately when they were fitted approx a month after I purchased them they were both punctured, I contacted the seller who told me that it in his opinion the garage fitting them wanted me to buy new tyres from them, I replied stating that the garage owner is a personnel friend, the seller replied stating that he was going on holiday and would contact me on his return. He made no contact and still has not and eBay has stated that it is over the 40 days period, even thou he did not reply to my mails within the 40 days.
I have the sellers phone number but have been advised not to call is this correct? I am considering taking out a small claims or the police or both.
All emails have given the seller the benefit of the doubt and certainly not confrontational
Has anyone out there had a similar experience? Please help.

You have 45 days to make a claim through paypal, so you've already exceeded this now?
To be honest, I really think that you should have checked the tyres when you received them - could anybody have got to the tyres to damage them whilst in your possession?
It is a case of your word against his, and I personally think that if you are concerned enough to take to a small claims court then you should have been a little bit more on the ball - no offence intended0 -
It's a civil matter so the police won't be interested and certainly wouldn't thank you for bothering 'em. If the transaction occurred towards the end of August you're still -- just -- within the dispute procedure time scale. If not, then Small Claims is your only option though with what chance of success, who knows?0

The police won't be interested. You could try small claims court but you would have prove that they were damaged when you brought them which won't be easy considering you had them for a month before fitting. The seller will just say in court that they were fine when they were sold and the punctures must of happened afterwards.
I would see if you can savage anything from them and just remember to check items properly next time.0
