URGENT ADVICE re:Notice to Owner (NtO) letter received for Phantom PCN

Got letter from the loacl council demanding £70 or threat of increased fines (50% rise) for a ticket I never received.
On 3/9/09, I drove around for over 5min looking for parking as lot of cars in the area were double parked. I eventually found a spot next to a street lamp post on a side street (dead end street and not blocking any access). There was just enough space for my car. After stepping out of the car I noticed the rear tyre was just touching the yellow line. I recall someone once saying ALL of the tyre must be on the yellow line for it to be an offence, and so just in case - I took a photo of car on my iphone. Returned later that night and got into car and drove off - there was no PCN on my car so I assumed there was no parking offence caused.
Yesterday (10/10/09) - over a month later to my horror, I received "NtO" letter in post demanding payment - is this legitimate? I had no communication or PCN or reminder of unpaid PCN and now a over a month later (completely out of the blue) - I receive this letter of demand....Martin :money:Please Please can you advise or HELP!!! as I have never been in this situation B4.

Please remember to scan the front and back of all paperwork and to remove any identifiable details. The photo you took with your iPhone would help.
It looks like you've not been served with a PCN. The council can't just jump to an NtO - they must serve a PCN personally or via post. Various councils' failure to adhere to the rules means many appeals are won this way. Hopefully yours will be no different.
Once you've got the paperwork scanned and uploaded here someone should be along to help.0 -
I managed to log onto the council website and look at the "Evidence" regards to my vehicle parked on double yellow lines. There is a photograph showing a "warning" sticker on my window. When I came to my car on that same night, there was NOTHING on my window??? it must have been blown off or someone may have removed the ticket. I now don't know how to appeal or complete the NtO form! The photo shows the rear wheel on yellow lines and if there was a ticket on my car, I would have paid it but i never saw the ticket on my car so what do I do? the photo showing position of motor car can be viewed @ tinypic site ".../i33.tinypic.com/28i70g8.jpg"
Also I received no letter/communication from council stating that I have unpaid ticket - so how can I pay a fine if I don't know that I have one outstanding; also why did they leave so long before sending NtO? I still don't understand why I am issued with this parking ticket when only just the rear wheel was on the yellow line?? please can someone assist me with this query. Thank you in advance.0 -
My father told me he got done a few years ago because the car overhung the yellow line.

Sorry but that's not 'just on' the yellow line, it's well over and into the double yellows!
But never one to put someone off trying to appeal a parking ticket, I suggest you scan in a copy of the NTO - with your details blanked out - and say which Council it was please (some on here are aware of which Councils may have a history of phantom PCNs and/or non-compliant paperwork).
It may be that someone can help you if you can scan the NTO in and give the Council name. At least I have bumped your query. Maybe you can still appeal (just not for the reason that your wheel was 'just on' the line...).:rotfl:PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Maybe you should suggest paying half the ticket as only half the car was on the double yellows??
Or maybe zero because the drivers seat [the only bit you were really using] is not on the yellows??0 -

a few years ago - I got letters from Westminister City Council for unpaid PCNs but I was in Derby at the time of incidents...so I reported the case to police as someone may have cloned my plate but they would not even give me a crime number!0

...and BFG - no I did not pay the fines! I appealed with evidence and they did not even bother to reply back and after all these years, I never received any further communication from them.
