Are tax credits affected if I move in with parents

Hi,
I have separated from my husband but he will not move out of the house. I have decided to move in to my parents house for the time being with my little boy. Can anyone tell me if I will be entitled to anymore tax credits now that I am a single parent with only my income to support my son and I. My husband will pay maintainence but that is all. Even though I will be living with my parents I will still need to contribute to food and pay some rent. Does that fact that I will be moving in with my parents mean that I will not be entitled to anymore than the basic credits that I get now?
I would rather he moved out the house but this is not going to happen and I cant bear to stay in the same house any longer.

Without more details it is impossible to say. What about your current home, do you own it ? pay rent ? What about work ? are you on benefits ? will you be ? Are you getting Child tax credits or working tax credits ? How much maintenance will you receive ? Is this agreed ?
You can't get housing benefit for a property which your parents live in so anything you pay them will have to be from other resources.0 -
Have you seen a solicitor? Before moving out of your home, you should seek legal advice - it may well be that he should be the one moving out if you have a child.0

You really must see a solicitor before you move out - you have to find out your legal rights here. Yourn local CAB will probably either have a list of local solicitors who do legal aid or have a solicitor visiting regularly who can advise you. You don't say whether you're renting or buying but either way, you need to know what you might be giving up if you move out.0

Thank you everyone for your replies. We rent our house and we both work. I work part time and he works full time. I can not afford to keep the house we live in at the moment as my income just wouldnt cover the bills. My husband has agreed to pay £250 per month maintainence and will contribute towards clothing and other extras. I currently get £10 per week for my son child tax credit and do not qualify for working tax credit as our joint income is too much. My salary is only £7800 per annum which is why I can not afford keep the house myself so at the moment I see my only option is to move in with my parents. I know I cant claim housing benefit if I live with them but wondered if I can get any other help.0

there would of been income support to claim as a single parent but your maintenance would be too highto get it. If you stayed in the house and he moved out you would of qualified for some housing benefit. You will probably recieved some wtc also as its now just your income. You need to close down your joint tax credits claim and apply for a single claim0

i was living with my mam and dad, 2 two years with my 2 children.
The adviser at the job centre did all my claim forms 4 me, and i got extra. she said it would only affect you if they were claiming any benefits aswell.savings for 2012.. New year new me.. Going to save save save... and not spend spend spend. :rotfl:

as long as you work over 16 hours a week you will be entitled to CTC and WTC.
your child maintenance is disregarded for tax credit purposes.
www.entitledto.com is a good place to get figures.
When i was a lone parent working part time with 1 child, i received £100 tax credits a week, just to give you a rough guess.:j Baby boy Number 2, arrived 12th April 2009!:j0 -
£10 per week is not the correct tax credits. This is likely what you are receiving as a couple. You MUST inform tax credits you have seperated as you will be overpaid unless you move to a single claim. On a single claim you will receive a lot more.0
