    It's Auctionair I'm claiming from.

I'm not claiming interest or loss of earnings, the interest because the online application wanted me to specify the number of days (I didn't know how long this would go on for) and loss of earnings because i didn't expect it to go as far as court.

The latest 'questionaire I have from the courts has offered the services of a mediator to try and resolve this dispute before it's actually heard in court. Do you think it's worth using this to settle the thing or would you see this as showing weekness or lack of confidence in my case?

    thanks

Just for future reference, on the court claim you put down the interest accrued to date together with the ongoing daily rate. It is then calculated at the time of judgment.

Why would you claim loss of earnings?

TYry the mediation - if they provide it free of charge - otherwise press on.

The loss of earnings I mentioned was in response to Vomityspice's "timeoff work?" which I took to mean in my case any cost incurred by me having to miss work to go to court.
  • Thanks for all responses so far!

I had a phone message left by Auctionair asking me to discuss our issues to resolution, so I called them back the next day. Basically they stiil hadn't changed their tune, taking no responsibility and blaming the manufacturer. They said they would get back to Sony again to ask for more compensation on my behalf.

I have a questionaire to fill in for the court which also asks if I have any witnesses (I don't) or an experts report (which I do sort of). The report from the Sony registered repairer mostly says how there's nothing wrong with this particular model, Sony products are well made and well engineered. All of which doesn't back me up. But his final sentence goes along the lines of "obviously if you buy an £1100 tv and it stops working after 18 months it's not fit for purpose".

Is this report going to benefit me in court or should I just omit it?

    Thanks again

His comments about the "model" are just general, but the last sentence seems to imply about your particular set, and IMO would be invaluable in court.

So you haven't actually got an engineer's report dealing specifically with the fault in question?
  • The engineers report does mention the details of the fault.

I think it should be specific to your TV, and put in detail what the fault was caused by (and leave out the "They normally work fine" stuff).

Good luck with this one :)
