Parcel arrived damaged..was thrown over backgate..

I purchased an item (talking parrot that repeats what you say) for my daughter as a stocking filler.

Yesterday I came home to find a parcel in the backgarden, which was over 2 m away from the backgate.

My husband tested the parrot, which was rattling inside and 1 of the wings is broken, it doesn't move like the other one does.

I contacted the seller (runs a business) to advise item was delivered damaged and explained how the delivery was made.

I just received the following reply:

Hi, it was sent via royal mail. It is unaceptable for this type of action. They should have obtain a signature from you and also treat the parcel with respect.


This doesn't help me much...where do I stand?

    organise with the seller to return it
    put in a complaint(not claim) with RM if thats how it was sent
