Hi
Just a quick one my mum is going to send off her MBNA loan agreement as she feels as though she was mis sold on a loan she had in 2003 however is it best to go to the FLA?
The loan was taken in 2003 and paid off in 2005 this is obv before the 2005 cut off date that i was made aware of by the GE money claim.
Any Help would be brilliant.
Cheers.

Hi there
Not sure if they would still have the copy of the agreement, if this is no longer active, but request for this anyway with the £1 postal order or cheque payment to cover this, this should arrive by 12 days, however if they cannot supply this they must return the payment back with an explanation.
I would follow the usual procedures on this first as you have been doing, as it may be a different matter for the MBNA to GE bank.;)The one and only "Dizzy Di"

Hi you send a letter for the reclaim to MBNA if it was them that actually sold the insurance to your mum. There is no need to send the agreement to them, just put your agreement number etc in the letter. You then have to give them 8 weeks for a full and final response and if they do not uphold it then send off the the Ombudsman. You will be OK using the FOS if you only just became aware of the misselling as MBNA are a bank and would be covered by them regardless of the dates. Don't forget to send the letter recorded delivery so you have a proof.liverpool1988 wrote: »Hi

Is it not possible that they could turn around and say that she has left it too long like the GE money account and that they dont have to deal with the complaint because it was before 2005?0
-
No, if its only just that she is making the complaint and has never complained about it before then this is fine. The banks were mostly covered by the Old Banking Ombudsman scheme before the FOS and FOS can look into complaints covered by them regardless of the time it was put onto the account if she only just became aware of the misselling.liverpool1988 wrote: »Is it not possible that they could turn around and say that she has left it too long like the GE money account and that they dont have to deal with the complaint because it was before 2005?0 -
So how come GE money said that? or is that because its an individual lending creditor?0

GE money would have had to have been GISC members if before 2005 and would be OK to use that excuse but with banks its different. The Ombudsman Service was set up fromliverpool1988 wrote: »So how come GE money said that? or is that because its an individual lending creditor?

The FSA today announced the appointment of the Board to run the new single Financial Services Ombudsman Scheme. The new Board will work with the FSA to merge the eight existing schemes in the financial services sector into a single one stop shop Ombudsman service, as proposed under the Financial Services and Markets Bill.
The new Financial Services Ombudsman Scheme will bring together The Banking Ombudsman; The Building Societies Ombudsman; The Investment Ombudsman; The Insurance Ombudsman; The PIA Ombudsman Bureau; The Personal Insurance Arbitration Service; The SFA Complaints Bureau and Arbitration Service;
Now this is why complaints where companies were not covered at the time are trying to be held against the insurers. They would also be under compulsory jursidiction as insurers would have been part of the Insurance Ombudsman. Banks are covered under the banking ombudsman.0 -
