Ebay advice please?

Can I have some advice please?
The scenario is that I bought a skirt on 1st Oct, paid immediately by paypal and messaged the seller through ebay to say that I go on holiday on 11th, so could she send it to me as soon as possible as I wanted to take it with me. She didn't reply, although having checked I can see that she listed several items on 2nd and 3rd Oct, so I am assuming she did get my message.
By yesterday (8th) it hadn't arrived, so I messaged her to ask when she posted it so I can ask my postman to make enquiries for me. She replied saying that there had been a delay in posting the item as she'd had to go to A&E with her child, but it should be with me tomorrow (today) but she didn't say when she had posted it. Well my post has been today, and the item still hasn't arrived.
If it doesn't come tomorrow then there will be no-one here to take delivery as I am going to be away for three weeks.
So, what do I do in that case? Start an item not received dispute and ask for my money back through paypal? Wait until I get back and see if the postman has left a card (but will the sorting office keep it for three weeks?).
And what do I do about the DSR's? I am not happy with the delivery time or the lack of communication, but she is a new seller with only 6 sales so if I do mark her down that could really trash her ratings. I don't want to be vindictive, so I'd be really grateful for some guidance on what I should do.
Thanks in advance
Daisy

Really you should have asked them before you bidded if they would be able to send the item straight away because of going on holiday. Although 7 days and not sending it is quite a long time. As for listing new items they may have been listed weeks ago but only went live on 1st/2nd.
I would ask the seller to refund your money and not post it as if they send it and your not there to recieve it then it could be returned (they only keep recorded items for a week and I think non-recorded for three weeks) which means she can provide proof she sent it. If the buyer won't refund you then I would wait till you come back and then make a claim but if its been sent recorded and returned I am not sure the claim would go through. I would think carefully about the negative as although the item should have been sent well before 7 days I would have e-mailed the seller beforehand if I wanted it as I was going on holiday just to see their response.0 -
I would have been happy to ask her not to post it till I get back, but it is too late as the seller confirmed yesterday that she has sent it, and that it should have been here today, but didn't tell me when she sent it, so I have no idea how long it has been in the postal system.
Also, although in restrospect I probably should have asked her to confirm that she was able to send it straight away, before bidding, at that time there was still 10 days until I went on holiday (not counting the day I go). But if she had replied to say that there had been a problem and she was going to be late posting it, I would have just asked her to keep it until I got back. It is the lack of communication that has annoyed me, if she had kept me informed, or responded to my message this could have been avoided.
I have no intention of leaving a neg, it is the DSR's I wanted guidance about. I don't feel that her service deserves a 5 for delivery or communication, but at the same time I have no wish to cause ebay problems for an obviously inexperienced seller.I'm a retired employment solicitor. You should leave ratings based on your experience. If you feel that she deserves one star as its taken her 7 days to post something then you should give her one star. Its very easy to make excuses for people but feedback and ratings only works if people are honest. If no-one marked people down then they would get away with doing as they please.0 -
I find it odd that taking a child to A and E (and as a mother I have done that on mnay ocassions) delays a parcel for over week?

Thank you. That was my feeling. I have spent many long hours at A&E with my son on occasions, but I wouldn't have expected it to cause a delay of more than a day or two (allowing for the fact that a sick child might have to be looked after, so she might have to get someone else to post the parcel for her).
Anyway, not to worry, if it doesn't turn up I'll sort it out when I get back.
Thanks for your comments.

I'd open a dispute, neg' them and 1* them.
A 7 day wait without being told why is unacceptable.Terms & Conditions Apply0 -
Hi, the skirt has turned up. She posted it on 8th Oct, which was the day I chased her about it, and 7 days after I paid for it. Given that she knew I was going on holiday, and that she didn't even bother to contact me to warn me that she hadn't even posted it yet I think that service is unacceptable - especially in view of the postal strikes.
On top of that the colour on the listing was light beige, in fact it is dark brown, so all in all, she messed up on this one! But it is a nice skirt and she is an inexperienced seller. I won't neg her, as she did come through in the end, but I will reflect the service in the DSRs.
Thanks to everyone for your input.
