Returning satnav advice

Hi im new to this forum but i thought you might be able to help!
Tuesday-
I reserved a tom tom one iq to pick up from a halfords store,and on my way home from work i picked it up. the lady in the store collected the satnav from the back of the shop and they passed it me and walked away. i then payed for the item and went on my way.
i got home and opened my satnav and connected it to my computer at this point i realised the amount of extra charges that occure with tomtoms. the on that annoyed me was todo with the iq system.

bare with me here. the tomtom 1 has no iq the tomtom 1 iq is £30 more expensive but it keep you off busy roads to get you places quicker. the problem is that every 3months tom tom update their maps and on those new maps there is new iq data thus keeping you on the quicker roads but this costs £7:95 every 3 months. i refuse to pay for this update as i feel im been mislead there is nothing on the box,on the website or was explained to me when i bought the satnav!

so i ring up to return it and the girl on the phone tells me they do not return satnavs at all unless faulty. i feel this should have been explained to me at purchase at that i am intitled to return the item!

anyone know my rights with this?am i entitled or do i have to keep the satnav? ill be phoning a manager tomorrow and hope to have something to tell him!?

  • p.s I wouldnt have bought the satnav if i had known i could not return it. who would spend £120 without been able to return espically knowing you have 7days if i had paid online and picked it up! i could have done that instore on my phone!

    The only relevent restriction that I can see in their t&cs is this one...
    Please note: Satellite Navigation systems/units also CANNOT be returned to stores unless they are returned complete in all their original packaging, with ALL security seals still intact.
    Are all the security seals intact?
    I guess not as you connected it to your computer.
    Then they are within their rights.
    Distant Selling Regs don't apply because you bought it in the store.

    Simply, if there is nothing wrong with the product, then they do not have to replace or refund the thing.
    Their website does explain their Unwanted Goods policy (see link above), but they are not obliged to refund just because you have changed your mind.

    Having said all that, if you had not even looked at the website, but just wandered into a store and bought it, I too would have liked this condition to be brought to my attention.
    But as this condition doesn't actually restrict your statutory rights, they probably don't have to tell you.

    When you reserved the thing on their website, did you have to tick a box confirming you had read the T&Cs?
    I think this may be what it comes down to... did you agree to their terms?
  • Thanks for the reply, when reserving online it doesnt have any tick boxes reguarding the Terms and conditions. but i certainly feel i should have been informed at the cash desk. when you buy a pair of pants the sales person explains there is a no return on these items once bought! they only cost a few quid satnav £130 go figure!

    The only info the lady who passed my satnav to me said was- keep the receipt because thats your 1 year warranty.
    if i dont get a refund im certainly going to take this futher i think its completely unfair of a massive company not to tell people its unreturnablethey had 3 oppurtunitys to tell me this info and i got nothing!

    Would you buy a Map Book and expect them to give you a new one every 3 months?

    its common sense that it would need updating but i think every 3 months is an exageration [sp] oh updates his once a year but then again its a driving aid he doesnt depend on it .

    I do not have this model (I've just got the standard 'ONE'), but as far I know, the IQ routes do not require a subscription.

    There is the HD Traffic, safety cameras and the like, which do require a subscription, but this is not the price you stated, and it nothing to do with the IQ routes information, but 'live' traffic information.

    You should get (and provide!) the IQ routes info when you sync it up to your computer. I know it does try to 'sell' you these other things, but this won't (or would not seem to!) the IQ routes info.

    The IQ routes are built into the map and are updated with the map. As far as I can tell (and been using IQ routes for almost a year and 3 map updates) the IQ routes is not really that effective anyway. Constantly I get sent into the M8 at rush hour when it has always had tailbacks for the past 7 years I have been driving the route. I connect mine to the free RDS traffic service and this does a much better job and before anybody jumps in and screams its rotten, I know its not the fastest at updating but I usually get plenty of warning and it has got better as now even roadworks and delays on minor roads are given for my area. At least I can avoid the "fastest Route" that IQ want me to take

    Just remember that the IQ route data is not like a live service and only goes on historical information and if there is not enough info then no IQ anyway. The monthly price you pay is primaraily for the Map update and is a good deal as it costs more to update once a year than it does to update quarterly.

    No, the law is that you have no right to return unwanted goods if bought in person.

    Halfords may offer a returns policy on other goods, but they can exclude SatNavs if they want to.

    Nope, you aren't entitled to return it. They don't have to tell you that you can't return it, as legally, once opened, unless faulty, you have no legal right to return it.

    In future, do more research on what you are buying, you'll have to put this down to experience I'm afraid...
