Hi all,
My OH bought an item on ebay over 4 weeks ago. It never turned up, seller didn't respond to emails enquiring about its wherabouts.
My OH raised a dispute, and then escalated it to a claim for item not received which seemed to focus her mind somewhat because she then got in touch. She gave the normal excuses and then said that she wasn't sure whether or not her boyfriend had posted the item and she would check. This was a normal ebay message by the way, not a response to the claim!
Today she sent another message to say that she was about to send the item, when she suddenly realised that my OH had raised a claim through paypal. She now says that she won't send the item unless the claim is closed, as she 'doesn't want to risk losing her money and the item'. Again, no response to the claim, this was just a normal message through ebay.
So how to word the response? I told him to just reply that he wouldn't risk losing the money and the item either (as if he closes the claim he then can't raise another one if the item doesn't turn up) and so he would not be closing the claim until the item arrives. But I am probably blunter than he is, so any better suggestions would be appreciated!!!! Thanks :beer:

Dont close the claim. If you do and the item is not sent you cant open another one. I would just leave the claim and let them refund you as I wouldn't trust the seller0

you can however change your claim later on from an Item not received to an Item significantly not as described .... but id just get my money back and Neg her for it....0

thank you for your recent email regarding the dolls I purchased fromn you 4 weeks ago. I appreciate your dilema but am unable to close my dispute as to do so would indicate i have received and am happy with the items I have purchased, and should i then not recieve, or receive damaged items (which is known to happen with our postal service) I have no way to then reopen a claim with paypal
I understand your concern over losing your money/items but please understand that once you post the dolls via a trackable service I will have to sign when I recieve them which will be recorded by royal mail. Paypal will not refund money to a buyer when a signature for receipt of item is forthcoming
I ask that you post the dolls out to me at your earliest convenience and that you please email when you have done so. I will email you back as soon as the dolls arrive and will close my case at the same time.
If you are still conerned please feel free to view my feedback.

Just a quick update on this, and a couple of questions again if I may!
My OH replied to the seller basically saying he wasn't willing to close the case bafore she sent the items, as by closing the case he was signalling that the transaction had been concluded to his satisfaction, and that he would then have no further recourse if he didn't receive the item.
He didn't receive a reply to this, but she did update the paypal claim at this point with a laughably fake tracking number! Paypal then updated the claim with information that this new information would be investigated by the end of October, obviously giving the seller ample time to clear out her paypal account!
So with not much hope, OH bit the bullet and rang paypal last night. Unexpectedly they were really helpful, the adviser took one look at the ridiculous tracking number and immediately reversed the transaction so the money has been refunded! :T My OH was so impressed that he actually stayed on the line in order to complete the customer satisfaction survey!
I've just got a couple more questions now - how does he report her as a Non Performing Seller? I've tried the ebay help pages but it just talks about 'reporting a seller', not actually giving a strike? And if he does this, will he still be able to leave feedback.
Having looked a bit more closely at her feedback, which is about 98% if I recall, it appears that she has done this to people in the past - she sells a lot of relatively low value items to keep her feedback scores high, but the expensive ones (this was worth over £100) never seem to make it out to the buyers, strange that....0 -
I think you can report NPS under the "Contact Ebay" link at the top of your Ebay page. (never had to do this). It will give you various options to choose from.
Or check on the community Q&A on Ebay for links to the right page - use the search box for non performing seller - you will find the link there. (i would post it here but I can't do linky bits!)

Are you sure? I won an item on Sept 6th and when I looked last night I wasn't able to leave feedback.:heart2: Love isn't finding someone you can live with. It's finding someone you can't live without :heart2:0
