Can a online shop change the price after sale?

Hello,

I was wondering whether someone could help me. I ordered a (Samsung N120) laptop off 1stAudioDigital.com last week for £325. However, they've sent me a message saying that this was phantom stock and is no longer available. They've offered me any laptop at cost price to apologise for the inconvience. However, I notice that they are still advertising the laptop for sale but at a price of £385 instead. It seems like the price has gone up on lots of retailers ... I'm wondering whether there has been a price hike from Samsung and 1stAudioDigital dont want to sell it too me that cheap anymore. If I've already got a receipt for the product should 1stAudioDigital honour the initial price that they quoted?

Any help would be greatly appreciated.

Many thanks,

Tom

I would say the more expensive one is probably a slightly different variation to the model you ordered and if they gave you cost price it would be less than £325 anyway.
  • There's not a lot you can do to get them to honour the price - I mean, it would cost more in legal fees.

by the sounds of it you ordered one with a 3cell battery and the second has a 6 cell

    maybe other stuff too

check the spec thoroughly to see if they are the same

if they are you mite have something

i know that companies can cancel orders if they specify when contract is formed (usually delivery) but i actually dont know case law on when companies cancel a contract legally but lie about the reasons just to make a profit themselves?

i would think on first thought you have nothing and could request a full refund as no contract has been formed (if it has then they either have to get you the goods if they have it or give you a refund anyways) dont let them give you credit, unless yo wish to take in which case feel free.
    Back by no demand whatsoever.

It definitely is the same laptop and the same spec. They haven't billed me yet. .. they just issued me with a receipt.

I suspect its because Samsung brought in a universal price increase (as almost all the suppliers have increased their prices by a similar amount). The price has gone up by about £60 and I'm guessing thats more than the mark up they the company make - therefore if they honoured their price they'd probably be making a loss...

However, I'd still like the laptop but dont want to pay another £60 more than I initially agreed!
