vehicle wrongly registered at my address: PCN bailiffs
I have had a bailiffs notice for a parking PCN committed in Croydon. The vehicle in question was apparently registered in another persons name at my address. I think this was probably a mistake as the individual lived at number 2b whereas I live at No.26. The vehicle user is a registered disabled person and the vehicle was supplied by Motability (no doubt through a dealer).
Mistakenly as it turns out I had for over a year merely been posting any letters in her door with a request to sort things out. I did, phone Croydon BC to give them this information and sent back some letters with the info on the reverse.
Now Croydon and the bailiffs have in effecct asked me to prove a negative: i.e. that she does not live at my address. Have written to all the "usual suspect" The lady no longer owns the car aand appears to have moved from 2b
Does anyone have further advice.? does anyone know the legal position?

Doesn't the fact you can demonstrate that the owner lives, or at least lived, at 2b rather than 26 prove she doen't live with you?
It should be quite easy to prove she lived there e.g. current owner confirming, electoral role, etc.

Thanks Premier . I have given the information to Croydon BC in the past by phone and returning unopened with notes on the back their brown envelopes. Unfortunately I did not write a letter. On the phone when Icalled them again, I am afraid that their attitude seems to be that Ishould prove that she does not live with me ! I have now made a formal complaint and at the same time provided them with the information.0

If you write to:

DVLA
Swansea
SA99 1ZZ
they will be able to send you a letter confirming that you have no connection with the vehicle in question.
You will need to provide the vehicle's registration mark (this MUST be included - contact bailiffs/council for it if you do not know it as DVLA cannot help with out), make/model (if known), your details and explain what you have in your first post above.
Mark it as urgent and explain about the baliffs.
You should get a letter back within 10-14 days confirming you have no connection. Keep the original letter and send photocopy to bailiffs/council.

I had a similar situation where I kept getting letters for the previous tenant of my house. They were from HSBC demanding payment of £20,000 for overdue credit card bills. I kept posting them back saying no longer lives hear on the front, but still they came until they started to come from baliffs saying they would be there in the week to recover funds. Just a quick call to the baliffs to say the person no longer lived here and I never heard anything since. All sorted.
Hpe it works out easy for you, but you have nothing to worry about. Just tell them the truth.0 -
I'm afraid when it comes to bailiffs and cars, it is never so simple. The bailiffs can check very easily if the car is in your name. Let them do the running around! As for the council, they can check the electoral role/council tax etc. as proof that this person lived at another address. Bailiffs have a habit of driving past a house and taking down the registration number of any car in the vicinity and assuming its yours. They know even if it isn't most people will panic and not want a neighbours car levied, so contact them and pay. In your case, I would tell them to do their own dirty work!0
