Harassment

Hi M8s
Any 1 out there can give me advice on the situation I am in; I have a property for students living accommodations while in study.

When they have left the property some of them have credit with banks and local councils for not paying there debt therefore the creditors start chasing them.

Because in the past our front door have been smashed by the bailiffs for force entry because we use to throw all letters addressed to our clients for none payments to the Courts and local Councils, Banks etc, for not sending them back to the sender this did cause chaos.

Therefore I decided in opening every private letters sent at our property and informing them that the addressee has left the property and if you continue sending letters while informed you may be committing offence such as harassment under Section 40 of Administration of Justice Act 1970.

I have come to a situation that I can no longer keep replying to companies when they do not stop.

Shall I now complain to OFT or can any 1 advice me what I should do now to protect my property from bailiffs coming again and damaging the property. I thank you for your help and time.

    strike the address and put it back in the post box with "not known at this address" written across it. Job done.

  • Thanks LeeSouthEast I appreciate your advice unfortunately some letters do not have the return address written in the back of the envelope and some letters come from county court, how do I deal with this kind of letters? I really appreciate your further advice because I am dealing with the maniacs they just do not stop, and doing nothing has caused damage to my property in the past costing me hundreds of pounds in repairs. Please I will really appreciate your further advice. Thanks for your time trying to help.

    If you know where they were studying ask the uni/collage if they have any contact details(they may have parents address through emergancy contact details). Maybe a long shot but try putting their name into sites like bebo, facebook if they have an account you could try contacting them.

    I think you might be better putting this on the housing board,other landlords may be able to give you more advice.Only thing I can think of is to insist they give you some care of addresses when you first accept them.I know bailiffs are ruthless,but I don't think they have any business damaging a door in a rented property.They only need to check with the council to see who owns it, so I think they themselves would be liable for this cost. Perhaps you could get advice from Victim Support? Find out if the bailiff belongs to a trade association.

    If you had a sign in the window with the landlords details,would this not avoid the door breaking,in future?

    Just put 'not known at this address' on thre envelope and put back in the post box.

    Royal Mail will open them and officially get them back to the sender [takes a few weeks usually].

    Once the court is officially aware they should stop pestering you; other creditors, well that's another matter.

    perhaps you should make it a part of the lease agreement that teneants have organise and prove a redirection is set up upon ending the tenancy?

    Just do as post 2 opening the post is an offence in its own right.

    A bailiff can not break in sure your students did not just lock themselves out. ?
  • Gathering information from college or privies addresses is the last thing any one wants to get involved with because when the students do find out life could be in danger, I think as LeeSouthEast said I will stick with sending the letters back as NOT KNOWN AT THIS ADDRESS and fingers crossed they may stop bombarding with letters. Thanks for your time a very good advice I am already feeling well. I will definitely let you know when the number of letters stop coming in post and I am going to return 43 letters in post today. Thanks again.
  • When I moved into my flat about 10 years ago I repeatedly received mail for the previous resident, despite returning the post with 'return to sender' etc the mail continued, my postie told me to contact customer services as they could arrange to have post sent to a named person stopped at the sorting office, they sent me a form to complete and the post stopped, so it might be more expedient to get some of these forms and then you would only need to do this once for each former tenant.
